praiseworthy very respectfully LOCUM TENENS juries in the BEAVER neaver feb 1874 editor deseret news weds in a late issue of the NEWS I 1 discovered an article purporting to t be a private letter from judge mckean to general morrow I 1 have not time to notice all of the tho misrepresentations in it IL As far as the second judicial district goes the writer of the letter is far from the truth judge hawley found but one difficulty in the way of getting a lawful jury both grand and petit and that was his ignorance of the law he discarded the territorial marshal to be sure but ho he supplied his place with ellsoos ell eli sors through whom he im in panelled panel led both gr grand find and petit jurors and attempted to try one case on chargo charge of murder ibanes canes attorney filed a bill of exceptions founded antho on the statutes of utah in which he showed eight points and might have found several more wherein his honor had deviated the law was good enough but tile the judge had not ot foll followed owea it hence was under the necessity of dismissing and holding the defend defendant arlt ailt to another term which lie got appointed by proclamation of the governor at which term however judge hawley never appeared but subsequently went out of office and left the case ease to his successor when judge norem borem boreman an came into office 1 he did not feel justified in boqi going behind the decision of the territorial supreme court by admitting the territorial marshal marshai Marst lal ial as a minister of his court but supplied liis his place like his predecessor with ellsoos and im panelled panel led what he considered lawful juries the grand jury indicted cane catle and the traverse traver sei jury ury found a verdict of guilty of murder but through some oversight probably not being familiar with the ole statutes they omitted to define the tho degree the defendants attorney very naturally took an exception which was interposed at the moment the prisoner was to have received his sentence seil sell tence judge boreman as in duty bound sustained the exception and held defendant to next term of court subsequently the prisoner asked the privilege e or of pleading guilty of murder in the second degree which was granted and he was sentenced to thirty years in the penitentiary this is the h p party arty referred to in mcleans Mc Keans Heans letter ietter le ter that could not be tried before aj a jury juny ury of his peers but was sentenced on his own plea of guilty should my statement be questioned I 1 appeal to the record of the court it is true that at tho last term of the second judicial district court there was no regular jury impanel led the judge refused to admit that he could not lawfully impanel one but acceded to the unanimous request of the bar not to do so we expect to see them in full blast at the april term I 1 did intend to notice other items but as long articles are seldom read and find are generally a trespass I 1 will c lose close for the present trusting as his honor judge mckean was some two hundred miles distant that as an honest man he will thank an eye and ear witness for putting him right before the public should he do so I 1 may kindly lend a helping hand band at some future time of need should he fall fail perhaps a maligned 0 community will take it kindly as from a friend
