Show 0 COURT FEES Is IN w what hat bat is termed the T U S fee pae bill of i 1853 1653 or an act to regulate the fee feet and costs to be allowed clerks marshals and attorneys of the circuit and district courts of the united states and for other purposes approved feb 26 are the following among other provisions clerks fecs fees for issuing and entering every a com commission mission summons capias execution warrant attachment or other writ except a writ of venire ventre summons or subpoena sub poona for a witness one ono dollar f i for filing and entering every declaration plea or other paper ten cents for wor administering every oath or affirmation to a witness or other perron permon except a juror ten cents for entering any return ruie rulo order continuance judgment decree 4 e or recognizance drawing at any Y bond or making auy any record certificate return or report for each follo folio fifteen cents and for lor a copy of any such entry or record or of any paper on file not exceeding one folio ten centa cent and for each additional ten cents for making dockets and indexes and for all other services on the trial or argument of a cause where issue is joined and ny given including venire and taxing cost costs three dollars for making dockets and in bexes and antl for al all ali lother lothen services in a cause where issue is 18 joined and no testimony given including taxing costs two dollars for making dockets and indexes and for taxing costs coats and other services ina lna in a cause which is nus fis missed discontinued or a judgment or decree is made or rell reli rendered dered therein without issue one dollar no district attorney marshal or clerk or their deputies shall receive any other or greater compensation for any services rendered by him than is provided in this act and a all ali 11 acts and parts of acts allowing to either of them any other or greater fees feer than is herein provided are hereby repealed and to receive any other or greater compensation nis is hereby declared to be a misdemeanor and if any officer hereinbefore mentioned or his deputy debuf y shall by reason or cover ot of his office wilfully and corruptly demand and fe receive any other or greater fees than those allowed in this act he be shall on ora conviction there thereof ofin in any court of the united State sf forfeit and pay a fine not exceeding nive five hunt hurl dred il ollars and be imprisoned not exceeding six months mont lis ils at the discretion of the tile court before whom the conviction shall be had that that before begore any bill of costs shall be taxed by allou any uy judge or other officer officers or allowed by any 0 meer officer of the treasury in favor of clerks mars marshals hais hnis commissioners or district tit jit attorneys torne V 8 the party claiming such bill aall shall prove by his hia own oath path or some other person having a knowledge of 0 the facts to bes ber be attached to suh such bill and filed therewith that thab tile services lees ices charged therein have been actually and necessarily ces ees cessa rily Y performed as therein stated these provisions llave have not only a general application to district courts in id the tho but are mad mads specially applicable to TO this territory by the following ni in tha poland bill the act of the congress of the united states entitled an act to regulate the fees and to be allowed til owed clerks marshals and attorneys of the thet circuit and district courts odthe of the united states and for other purposes approved february february twenty six eighteen hundred and anu aft nifty fifty y three threce is extended over and hall dhali apply to the fees nees ees of officers in said territory of utah A legitimate and proper question now 11 ll i are the fees exacted by the court officers named lik ilk in the tbt district courts of this territory in lil ac cordan ce with the above ra rates aud kud if not then why noi nor F |
