I IMPROVEMENT DISTRICT NO. 3, KEARNS, UTAH i EXHIBIT A (FORM OF NOTICE) Notice is Hereby given that the Board of County Commissioners of Salt Lake County, Utah, has created Special Improvement District Number 3 of said county which district comprises the territory as described in the Resolution that follows. On Monday, the 23 day of January, 1961, at 10:30 o'clock A.M., said Board of County Commissioners will hold a hearing in Room 206 in Salt Lake City in said of the City end County Building county at which time it will hear all objections to the creation of said district, the making of the prooosed improvement to be made therein, and arguments relating to the benefits accruing to any tract, block, lot or parcel of land therein and the amount proposed to be' assessed against any such tract, block, lot or parcel of land. At such hearing any interested person will be heard and any owner of property proposed to be assessed will be heard on the question of whether his property will be benefited by the prooosed improvement to the amount of the proposed assessment against his property and on the question of whether the amount assessed against his prooerty constitutes more than his proper proportionate share of the total cost of the improvement. The concrete sidewalks along the proposed improvement is to construct streets described in the Resolution that follows. Plans and specifications are available for public inspection in 'the office of the County Clerk of Salt Lake County and at the office of the Project Engineer, John E. Kay, No. 7 Kensington Avenue, Salt Lake City, Utah. The estimated cost is $566,603.06. Said resolution proposes the levy of assessments against the property in said district and sets out the amount of the proposed assessment against each tract, block, lot or parcel of land. A copy of said resolution appears in the Dec. 21, 1960 issue of the Valley View News newspaper. At the aforementioned hearing the Board of County Commissioners will make such changes in the proposed assessment as it deems ap propriate and may eliminate a portion or portions of the proposed improvement. However, no assessment will be increased withut another hearinq given pursuant to published notice as required by law. IF THE OWNER OF PROPERTY ASSESSED DOES NOT PAY HIS ASSESSMENT THIRTY (30) DAY AFTER PUBLICATION OF THE IN FULL WITHIN NOTICE of the adoption of the resolution levying such assessments as may be fixed after the aforementioned hearing, it will be con- clusively presumed that he exercises his ootion under Section of the Utah Code, 1953, TO PAY THE AMOUNT DUE IN TEN 17-7-- (10) THE UNPAID PORTION OF WHICH INSTALLMENTS, EQUAL ANNUAL WILL BEAR INTEREST AT A RATE NO HIGHER THAN SEVEN PER CENT PER ANNUM. on public property, such as All improvements lawns, sprinkling systems, rock gardens, curbs, wall, fences, etc. which have been built or installed by property owners within the boundary of the proposed sidewalks cf the streets to be improved must be removed by the property owners or at their expense, prior to the commence ment of the construction of the project.
