For years the city owned the property and it was an often used roadway, bridging two busy streets in the middle of the city. Now it is a walkway, and it seems theres an abundance of religious iconography around. The church has made many changes to the area, but they havent put up any fences, nor will they. The rub came when the church actually exercised their right to kick people off their land. There was an incident when some Baptist guy handed out leaflets or something on conference weekend, and they arrested him. The ACLU quickly got involved, suing over the restriction of free speech and saying the city cant auction off the publics s tights to the highest bidder. ACLU lawyers argued that the plaza has historically been used as a public area, which the U.S. Supreme Court has called a hallmark of a traditional public forum, and the new ownership must continue to protect the rights of free speech for the public. The Utah court dismissed the case, and thats when peoples underwear really bunched up. The papers and talk shows were clogged with people giving their opinions on die subject. Some people said it was a blow to civil rights in general, free speech specifically. Some people said the church essentially founded this state, and they can do what they want to. Some people said it was an egregious affront to the spirit of the constitution (I dont even know whose side they were on). My favorite opinions came from people who said the terms of the sale contract are clear (diey are), and die contract gives the church the right to give people the boot (it does, and they do). Of course some arguments are compelling, but honestly, L dont want to hear them anymore. I know a handful of law school grads who literally foam at the mouth when they think about the opportunity to argue the constitutionality of any topic. I know there are at least two sides to any discussion, and Ive heard all theirs, so let me give mine. I normally take a libertarian, personal freedoms all the way: down die line stance on issues such as this. But in this case, my thought is why? Why would anyone need so desperately to make a scene on that particular spot? Why not go across die street and use a bullhorn? Do they need to do it just to prove they can? Im reminded of something comedian Dennis Miller said several years ago when diere was a furor raised over people burning the American flag. He said, Sure, I could burn the flag, but why would I want to? As long as Im at it, why not tie it into knots and try to pass it through my colon? And that is essentially my point; people get so caught up in trying to exercise their rights they lose sight of reason. It seems diey need to do the most outrageous things to get themselves noticed, and if some people dont like it, then even better. They thrive on trouble. My mom is back in Arizona now (thank god), but this still resonates in my head, and it reminds me of something she told me long ago. There are people you dont want to piss off, She told me. We also nip at Nevadas heels in the least precipitation category. Add these dismal statistics to the fact that were facing an incredible drought (do you even remember what snow looks like?) and the outcome doesnt look pretty think brown lawns and forest fires. Wasting water may mean job security for poor college students seeking to repay loans by fighting these blazes but in actuality its just plain irresponsible. It may be a little tough to tame that faucet into ceasing its flow, but consider it your good deed for the day. 03 |
