Show 2 BOX ELDER JOURNAL, Brigham City, Thursday, April 6, 1972 The story should read: Mr. and Mrs. So and So announce the engagement Lotto rs to Questions Tardy Action Concerning Brigham Citys public works Ordinance 321, my open letter to the mayor printed in the Box Elder Journal on concluded, as follows: I am certain that the city attorney will concur with me if I contend that the city must either fill the vacancy or repeal Ordinance 321. The question of ex post facto in such a repeal action must also be considered. This letter resulted in no action by the city administration at that time. On March 16 1 wrote another letter to the editor which did get results as per the following entry in the council minutes of March 23: Mayor Zundel reported he had conferred with the city attorney and it was his opinion that an ordinance rescinding the public works ordinance would have to be prepared. A council motion was adopted to authorize this step. While I am happy that my individual efforts finally succeeded in getting the city officials to take this belated action, I also maintain that the city attorneys opinion should have been asked for right after die resignation of the former public works director, who gave the city a notice so as to enable the city to advertise for a replacement, if they intended to do so. However, it was clearly evident at that time that the city officials had no intention whatsoever to get a replacement and that they chose to leave the office of the public works director vacant, clearly in violation of the Ordinance 321. It is axiomatic (clearly understood), in law, that lawmakers cannot make changes in a law ex post facto (after the fact or (ordinance) retroactively) just to suit whims or altered circumstances, without due process of law. Either you enforce the ordinance or you take immediate steps to annul it; you dont dillydally for over six months to do so, as in this instance. May I suggest that the council and the mayor invite the city attorney to attend city council meetings again regularly, so as to have his ready counsel anent all moot procedural and legal aspects of council actions. It might also be helpful if all the departmental supervisors and one-mont- hs superintendents would again attend the meetings regularly, as was customary in the ui'iwr.: . 1 1 People may ask why I keep fighting city hall: One answer might be : I do get salutary results at times, like in the instance discussed in the foregoing. Another reason for writing these letters to the editor is that some people do enjoy the quaint manner in which I manhandle the English language in voicing my open and independent views. Acting as a devils advocate or catalyst is in the public interest and quite necessary if the democratic process is to prevail, as long as my letters are factual, interesting and inoffensive. sincerely, Adolph Kaltwasser, Brigham City Stake Plans Laurels Night BC The Brigham City LDS stake is planning a Laurels standard night Wednesday, April 12, h starting at 8 p.m. at the ward. The announcement was made this week by Carol Ann McCann, publicity director. The theme of the event is Happiness Is, and all Laurels and their mothers are invited to attend, she said. Mr. and Mrs. Glen Hawkes are scheduled as guest speakers along with Mrs. Bruce Baird and her daughter, Nancy. Musical numbers will be featured by Julie Miller and Kristine Armstrong. Men have been getting the raw deal for centuries and it's about time they get some consideration. Women can now open doors for men. It would look kinda unusual but a it's pretty good idea. Approximately the school districts population of students travels to school via bus. Total district enrollment is approximately 9,200. A fleet of 37 buses is used on daily runs with about eight other buses of the district fleet standing by for special academic or athletic oriented runs. Bus service is available to all students in the elementary grades living 1.5 miles, or more from school and for secondary students who live 2.0 miles, or more, from school. Some students tabulate as many as 100 miles daily.
