Show Lake Powell boaters The Halls Crossing Boatowners Association, with several individ- uals, filed suit in federal district court in Salt Lake on November 10, 1994, against Courtland Nelson, director of the State of Utah Division of Parks and Recreation and three county sue state tion over recreation in the assessors in southern Utah. The Glen Canyon g tional Recreation Area is located within San Juan, Kane, and Garfield coun-Cit- y ties and includes all of Lake Powell, The suit contends that the Division and the State of Utah do not have jurisdic Na-alon- Glen Canyon National Recreation Area. According to the suit, the federal government has federal lands and waters within the Recreation Area, and in doing so has preempted the state from those responsi- bilities. Over 140 boat owners are known to have been charged with criminal violations of the states boating law. During the summer and fall of 1994, the state charged the boat owners with failing to register their boats with the Division. Before the boat owner may register the boat, the county assessor must state that the owner has either paid the personal property tax or the boat is a lien for the tax, or that the boat is exempt from the tax. The Boatowners Association claims that the assessors are not exempting them 35-year-o- ld or other boat owners from payment of the tax. The Boatowners Association believe that all boaters who use their boats exclusively within the Glen Canyon Recreation Area are exempt fromt payment of the tax and are exempt from all other state regulation of their recreational activities on Lake Powell. The suit also alleges that even if the states boating laws could be applied to boaters, such laws are being selectively enforced to gather tax revenue. Neither the state nor the counties extend any meaningful services to boat owners within the Glen Canyon Recreation Area, according to the suit.
