RETURN OF ANY MONEY FORFEITURE. A. At the time the city council decides whether or not to grant petition for an extension, it shall also decide whether or not any portion of the costs is to be refunded and the manner and circumstances under which such refund shall be made or credited to the applicant, his successors or representatives. Such determination shall be duly recorded in writing and a copy thereof furnished to the - 14-33- applicant B. In the event any deposit remains unclaimed for a period of five years after the depositor has discontinued secondary water service, the deposit may be forfeited and then transferred to the secondary water utility fund. The secondary water system will not be installed at a depth that is necessarily below the frost level. The secondary water system will be closed and drained during such period of the year as the secondary water superintendent may determine in order to prevent damage to the system from freezing. LARGE USERS. The city council may permit utilization of the secondary water system by the county and the cemetery district for the golf course, recreational areas, parks and cemeteries free of charge, and by connections exceeding 1 in diameter. Such users, as well as other users of relatively large quantities of water, as the secondary water superintendent may determine, shall not be permitted to use the secondary water system during the period beginning one hour after 14-34- 0. 14-34- 14-34- sunset and ending one hour before sunrise except with the use of an automatic sprinkler system with timer. The WATERING. OVERNIGHT secondary water superintendent may prohibit the use of the secondary water system during the period beginning one hour after sunset and ending one hour before sunrise, by individual users or by all users, except with the use of automatic sprinkling systems with timers, if he determines that overnight watering is resulting in a waste of water. DECLARATION OF EASEMENT. There is hereby declared and established an easement across the properties of property owners within the City of Monticello along presently existing public utility easements for the installation of the secondary water system.
