Be it resolved by the Legislature of the State of Utah, of all members elected to each of the two houses voting in favor thereof: Section 1. It is proposed to amend Article 1, Section 13 of the Constitution of the State of Utah to read: Section 13. Offenses heretofore required to be prosecuted by indictment, shall be prosecuted by information after examination and commitment by a magistrate, unless the examination be waived by the accused with the consent of the State, or by Indictment, with or without such examination and commitment. The formation of the grand jury and the power and duties thereof shall be as prescribed by the Legislature. Section 2. The Secretary of State is directed to submit th proposed amendment to the electors of the State of Utah at the next general election in the manner as provided for by Article 23, Section 1, Constitution of Utah.
