Heinegar, 41, Orangeville, to a prision term of years during procedings of ' the Seventh District Court in Castle Dale on Aug. 30. Heinegar pleaded guilty to a second degree felony charge of aggravated sexual abuse of a child. The judge placed him in the custody of the Emery County sheriff to be transported to the Utah State Prison to begin his term. Kerry C. Killian, 18, Ferron, Mark Allen, 18, a former resident of Orangeville, and Terry Andrew Larsen, 18, 1-- 15 SAVE $50 Huntington, were in court for sentencing on felony burglary charges. Killian has relocated to Wyoming where he has been employed part time and has saved $600 to apply to his restitution and fines. The judge therefore reduced the charges to a class A and sentenced misdemeanor each defendant to one year in the Emery County Detention Center. The sentence was reduced to one year probation under the supervision of APP, and tiie judge ordered that they pay full restitution and a fine of $1,200 each. The restitution for each is: Killian, $1,457.51; Larsen and Allen, $102.50. Judge Bunnell encouraged the defendants to stay away from alcohol, saying it was determined that it was a factor in the crimes. He also ordered Killian to follow up with enlistment possibilities as part of the terms of his probation. The probation is in effect until all fines and restitution are made, and in the event any of the defendants fail to make payments, the other two will be held responsible. Phillip Frederick Cox, 30, Ferron, who is serving time in prison on a rape conviction was represented by his attorney John Bucher who petitioned the court to have Cox released while his case is pending appeal to the Supreme Court. Judge Bunnell denied the motion. Michael Don Horton, 22, Huntington, was sentenced to a term not to exceed 90 days in the custody of state corrections at the Utah State Prison. Horton is charged with three third degree felony forgeries. The judge said that Mr. Hortons problem with alcohol has been a big factor in the case, and noted that he has had several juvenile incidents that were also alcohol related.
