Of course, nudie cards and Playboy type magazines have always been available. But during the last few years, hard core porno flicks and magazines showing explicit sex acts and related gestures have infiltrated into most of Utahs population centers. Hardest hit is the Salt Lake metropolitan area. At present, there are at least six X rated adult movie theatres in Salt Lake. And while there are no known bookstores which sell only adult materials, there are several which have sections or segregated shelves which cater to Adult readers. To many people, pornography is a black and white issue: there is only one way to handle it, rid of it, by any means. In fact, citizens groups have been formed in many areas to ward off this evil. 1 am for morality and against evil. But if Ive learned anything in the short time Ive been around, its that no issue is completely black and white with just good and bad sides. Pronography is no exception. There is a very delicate and complicated balance between the right of society to protect itself from destructive influences and the right of the individual to freely express himself, or to fail, or even to be a pervert if he wishes. There is a long history of U. S. Supreme Court attempts to resolve this dilemma of the individual vs. society Two cases in particular have influenced most state and community attempts at to-g- pornography legislation. The first is the Roth case of 1957. Here, the Supreme Court for the first time tried to separate the First Amendment (freedom of expression) from obscenity. The Court ruled that obscenity is not expression. It then defined in a loose sort of way what obscenity is. The Court listed three conditions for a definition of obscenity: it must be prurient (wanton or debasing); it must violate contemporary standards of decency; and it must be utterly -- rjackassery.' - . I believe that in view of these complexities the State statute is, if enforced adequately, sufficient for the protection of individual and societal rights. Some municipalities and citizens groups advocate a much stronger approach. 1 disagree. In the first place laws are the effect of morality, not the cause. Prohibition should have taught that when men are corrupt laws are broken, and when men are pure laws are not needed. And secondly, if we were fascist enough to enforce stricter obscenity legislation, the legislation would have to receive the credit for our morality. Without choice there is no morality. Lets fight pornography, but not through legal fiction. The real will not be found in strict obscenity ordinances, but in ourselves. While this case helped, it also created a lot of confusion for state and community courts. For instance, what does community standards mean? What is a community? Who is an expert on community standards? Can pornography be of social value because it shows how not to act? Whats wanton or debasing to one individual may not be to another. Because of this abstract definition, then, the courts could arrive at no general judgment regarding obscenity. In 1973, however, the Supreme Court made a more explicit judgment (Miller vs. California). This time the Court defined community as what we know as a local community. It also stated that standards of decency could be established by the common populace. In addition, the Court ammended its former statement that obscenity must be totally without social value to read that a film or reading material must have artistic merit. In other words, a court prosecuting a porno flick would only have to prove that the film did not have artistic, literary, or philosophical merit; instead of needing to prove that that film was totally lacking in redeeming value. This more specific definition made things a lot easier for the courts. Utahs obscenity statute (76 10 1201) is for the most part based on the 1973 Supreme Court ruling. According to Roger Cutler, City Attorney for Salt Lake, the definition has led to a number of convictions in hard the pornography area. Most recently, a Salt Lake adult theatre had the film, Deep Throat, confiscated and was fined several hundred dollars. Other states havent had as much success. In California, for instance, a young lady recently stripped in a public bar and gyrated around the floor on her back. The State Court ruled the case as freedom of expression. California needs stronger obscenity legislation.
