F. Jensen Tax Case to Be Heard The case of the W. F. Jensen Candy Company versus the State Tax Commission of Utah, which is before the state supreme court, will be heard on Monday. ' This case is one in which the payment of sales tax is involved. The W. F. Jensen Candy company has questioned , the right of the state to collect, the 2 percent tax on sales, the aggregate amount of which is under 50 cents. The contention is that the dealer is prohibited by law from collecting more than 2 per cent sales tax, an impossible situation In the opinion of the candy company, where the 2 per cent on the sale amount to less than a penny. The tax commission last summer rejected the plea of the candy company, which now seeks the wisdom and ruling of the states highest court. A final ruling on the question will be welcomed, not only by the candy company, but by dealers and their matrons, who have engaged in many arguments on this phase of sales tax. Some patrons have complained that the 2 per cent on small sales provided a margin of profit on the tax for the dealer, a situation which the law obviously wanted to avoid. Dealers, on the other hand, contend that the smaller sales on which no tax is collected offsets any excess which is collected. In any event, the opinion of the supreme court should shed desirable enlightenment on a question which has been the subject of no end of petty argument : 4-- H - i are included Senator Herbert B.
