Norma Mae Shields returned TIIE JOKE IS ON THE EDITOR All of this is more or less water already under the bridge, since it happened a couple of weeks ago, but it sometimes takes a fellow that long to recognize something like this as a joke. Anyway, it happened like this: A couple of weeks ago our neighbor called us one night to tell us a cow was in our corn patch; we herded her out, looked dolefully at the corn she had knocked down, patched up our fence the best we could and went to bed with plenty of misgivings, since we had been unable to locate her owner and guessed she would be at large throughout the night. Our misgivings were well founded; sure enough, the next morning, there she was, back in the patch, carrying on her destruction from where we had interrupted her the night before. This time we tied her up and called the deputy city marshal to pen her up. Followed then the cumbersome procedure of finding neighbors who were willing to involve themselves in the duties of appraisal of damage and after a couple of false starts on this, which took another two or three days, the appraisers arrived at what they felt was an equitable damage figure, only to find out that the City Mayor had, in the meantime, ordered the critter released, and the owners 'took the attitude that We dont care now, weve got the cow back. Seems like the joke must be on us, doesnt it? But the sad part of it is, that the joke is also on every other citizen who tries to insure the success of the national scheme and his own winter supply of food by raising a Victory garden, for what applies to a cow in one corn patch must apply to all cows running a,t large. Now your editor has always taken the position that since a corn patch doesnt wander off at night biting peoples cows or uprooting the neighbors pigs, but stays respectably where it is planted, while the cows and pigs on the other hand, do wander off at night in search of forage when not properly taken care of at home, the responsibility of care was on the owner of the livestock, not on the gardener. This stand is backed up by certain ordinances in the published booklet entitled Revised Ordinances of City of Duchesne, from which we quote certain passages: all from Chapter III Section 90. CATTLE AND OTHER ANIMALS RUNNING AT LARGE TO BE IMPOUNDED, ETC AU cattle, horses, mules, sheep, goats, asses and swine are hereby prohibited from running at large within the limits of the city, and said animals are also prohibited from being herded, picketed or staked out upon any of the streets, sidewalks, or other public ground of this city. All of said animals so found may be impounded by the Marshal or other policeman of this city, in the City Pound. Any person who is the owner of or has any interest in any such animal as described in this section who shall permit it to run at large, or be herded, picketed or staked out, contrary to the provisions of this section, shall be deemed guilty of a misdemeanor and upon conviction thereof may be punished by a fine not to exceed fifty dollars, or by imprisonment for not more than thirty days, or by both such fine and imprisonment, for such offense . It shall be unlawful for any person to take his own animal or that of any other person out of the custody of a person holding-thsame for damages done by it, or out of the city pound, by stealth, fraud, or by force; and it shall be unlawful for any person to intercept or hinder anyone while in the discharge of his duty under the provisions of this chapter. The final sections of this chapter have to do with poundkeepers records, handling of the money and e penalties. All of this seemed pretty plain and definite to us, and we were proceeding accordingly, feeling secure in the belief that it was the duty of the officials to protect those who had been damagedcity in violation of its ordinances; but no-t- he Mayor said the ordinances are no good, and he should know for he is a good attorney. Which leave us where? In the future if a cow damages somebodys Victory garden he can either laugh R off or devise his own means of collecting retribution; the city ordinances have been pronounced no good and we have heard of no move on the part of the city officials to make them good. Yes indeed, the joke seems to be on the editor, on anyone else whose garden might be trampled by stray animals turned loose to forage on the nd townsite at night.
