Show Page B2 r ZDje AMENDED NOTICE OF ttr.r.7 j .Z'.ZZiXZSJi. k ORDINANCE 2004-0- 1 AN ORDINANCE AMENDING CHAPTER 13.25 OF THE MOAB MUNICIPAL CODE REGARDING WATER AND SEWER IMPACT FEES WHEREAS, the Utah Impact Fee Act mandates that municipalities establish ordinances and procedures for the equitable apportionment of costs for municipal capital improvements; and WHEREAS, the City has adopted an impact fee ordinance providing for standard water and sewer impact fees; and WHEREAS, development in the area north of Moab city limits necessitates the construction of a water line with sufficient capacity to meet build out projections for the area (North Area Waterline South Loop); and WHEREAS, a property owner has agreed to pay for all costs associated with the construction and installation of the North Area Waterline South Loop subject to a cost reimbursement agreement whereby the City collects impact fees from future connections to said line and reimburses said property owner for the cost of the North Area Waterline South Loop; and WHEREAS, an impact fee for the North Area Waterline South Loop is needed to ensure equitable apportionment of the cost of the waterline; NOW, THEREFORE, WE, THE GOVERNING BODY OF THE CITY OF MOAB HEREBY AMEND CHAPTER 13.25 13.25,030, AS FOLLOWS: Section C shall be added to Section 1 3.35.030 Service Areas, to read as follows: C. The Service area for the North Area Waterline South Loop impact fee shall include properties connecting to the North Area Waterline South Loop. Existing customers with city water service prior to the adoption of this fee that connect to the North Area Waterline South Loop will not be required to pay this impact fee except to the extent that such a customer increases their peak instantaneous demand after the adoption of this fee. Section D shall be added to Section 1 325.060 Calculation of Impact Fees, to read as follows: D. University of Texas students help out at Sand Flats A group of six students from the University of Texas, Austin, spent their spring break volunteering at Sand Flats Recreation Area, contributing over eighty hours of labor during the week of March 15. The group was hosted by Plateau Restoration, Moab, who led the service-learnin- g program. In addition to the project work, students participated in discussions, including natural history of the region, recreation management issues, invasive species and restoration efforts, with Plateau Restoration instructors. The students honed their engineering skills assembling picnic tables for a campground under construction, helped eliminate social trails on Fins and Things jeep trail and destroyed tamarisk at a spring site at Sand Flats. Tamarisk control was definitely a highlight of the volunteer project because participants said they could see an immediate difference and knew that their efforts g would have impact. All live tamarisk trees at the spring site (about fifteen in all) were hand dug and detached below the root crown. By cutting the trees below the root crown, they should not resprout. This method has found to be effective in eradicating tamarisk at Dinosaur National Monument. long-lastin- Prescribed burns scheduled for La Sal Mountains The MoabMonticello Ranger District announces the Prescribed Fire Program for this spring. Burning will occur between now and May 28, 2004, based on weather and burning conditions. On the Moab District, burning is planned on the east side of the La Sal Mountains around the Buckeye Reservoir area. On the Monticello District, burning is planned in several areas: around Blue Mountain Ranch, Milk Ranch Point, Kigalia and the Drill Hole area north of the Bears Ears.
