The counselor will provide intake assessments of problematic behaviors, and ongoing counseling. This reinstatement of the citizens' right to veto the legislative acts of local officials ensures that these officials are more responsive to the will of the people." In the case of "Bigler v. Vernon," judge Ray M. Harding of the Fourth District Court determined that tax- payers should have been allowed to refer a new 6 utility franchise tax to the voters. The suit was brought by members of the Utah Taxpayers Association who filed petitions with the city. Payson city officials refused to grant the petitions based on a 1987 law, Senate Bill 9, which Payson city claimed prevented citizens from invoking the right of initiative and referendum concerning tax and budget issues at the local level. The Taxpayers Assoc, has also brought suit against Sevier County which increased property taxes 50 in each of the last two years. Petitions were circulated and then signed by a sufficient number of voters to require a referendum vote, but county officials cited the 1987 law, claiming they were not required to allow a vote on property tax increases. The trial in the Sevier County case will be Wed., Nov. 13 in Richfield. The Payson City case which was just decided in favor of taxpayers dealt with the issue of a new tax. The Sevier County suit deals with an increase in property taxes. While the right of referendum on new taxes was upheld by the court, the court also ruled that the plaintiffs original petition was not filed within the thirty days as required by statute. If Payson citizens still want to vote on this tax, they must file a new petition to repeal the tax. Mr. Stephenson said the decision of whether to file another petition on the Payson utility franchise tax will be decided by the citizens of Payson. Utah Division of Wildlife Resources Fish Culture Coordinator Ron Creer says another 340,000 three to five inch rainbows will be stocked next spring. Scofield has historically been among the states top three trout fisheries. Creer says the reservoir will reopen to fishing May 23, 1992, in time for the Memorial Day holiday weekend. He says the trout stocked this week will reach 14 to 16 inches by mid-summ- |
