STATEREGION Land owners tired of tubers on area canals LOGAN (AP) Some prop- erty owners and canal company stockholders have grown tired of dealing with the abuses f discourteous recreation-ist- s who traditionally float the canals of Cache Valley. Hikers, joggers, motorcyclists and snowmobilers also traverse the trails beside the waterways, though canal company stockholders hold the rights of way for access to maintain the canals. But without specific permission from canal companies and private property owners, public use of the areas is an encroachment, said Robert Hill, an irrigation specialist for Utah State University. 'There are liability issues along with use of these canals," Hill said. "Do the canal companies fence their right of ways and put up signs saying, 'No trespassing'?" In the event of an accidental drowning, the grieving family could sue the canal company, Hill said. Such a case is pending in Utah County. When a tuber gets a laceration on his arm from a branch or on his foot from a broken beer bottle, Hill said, the canal company could be liable. , "And yet, are they treated as trespassers?"
