What really helped it leapfrog over St. Louis and Baltimore was that it offered the least legal risk of the three. "With the problems they had in St. Louis and Baltimore with the ownership groups, for whatever reason, (it) kind of cleared the way for us," said former Kansas City Chiefs safety Deron Cherry, a member of the Jacksonville ownership group. "We've got a very solid foundation." St. Louis had long thought it was a lock to get an expansion franchise. Orthwein, who had been the point man in the city's expansion effort, bailed out the league two years ago when it needed a buyer for the Patriots. He had an unwritten agreement with the league to eventually get an expansion franchise for St. Louis and then sell the Patriots. That almost certainly would've happened. But in September, unexpectedly withdrew from the St. Louis ownership group because of differences with another group member. The city never recovered from the blow. Now the ball is in Orthwein's court. He lives in St. Louis and wants to sell the Patriots. But, with Tuesday's vote, he might change his mind and keep the team. Or he could just sell the club to St. Louis buyers, who would move the team there. When asked before Tuesday's vote about the possibility of selling the Patriots to St. Louis bidders if St. Louis didn't get an expansion team, Orthwein's attorney, Waiter Metcalfe, told the Boston Globe: "If it happened, I think Jim would still sell the team to the highest bidder, and that could be this (Stan) Kroenke group from St. Louis." rt heir Kroenke, the who replaced Orthwein as the point man in St. Louis's failed expansion attempt, said Tuesday his group will meet in the next few days to decide what to do next.
