Nielsen. The Utah Highway Patrol had a banner year for interstate drug busts in 1987, collaring dozens of alleged couriers and dealers on southern Utah's alone. The Department of Public Safety is trying to turn the tables on dealers by using confiscated drug money to fund the battle against traffickers. The freeway drug busts have been highly publicized, but seizures of cash are not as well known, even though troopers have seized amounts as high as $500,000. Confiscated cash is turned over to a special forfeiture fund. A series of court hearings are then conducted, as the department tries to prove the money was generated through criminal enterprises, while the owner tries to establish that it was obtained legitimately. In most cases, the owners of the cash put in no claim for it. "We've now got in excess of $1 million in the forfeiture system in state and federal 1-- 70 . court," Nielsen said. "We won't get it all, but we will get a good share, a substantial amount. We want to turn around and use that money for drug interdiction." Nielsen said the UHP could be making more seizures if had more funding for equipment, better training and aerial surveillance. He sees the forfeited cash as a way to beef up the program. "It's a positive thing to make the malefactor pay for drug enforcement and to save drug-detecti- the taxpayers money," he said. "And it will increase our enforcement when we otherwise would be restrained by our budget." Nielsen said the UHP must in good faith use the money for drug enforcement, not the myriad of other programs and projects the UHP would like to fund. The patrol plans to heighten drug enforcement areas in different parts of the state. Because the UHP is funded by legislative appropriation, there is some question as to whether the patrol can keep its share of the cash or must turn it over to the Legislature to appropriate as it sees fit. "It's our opinion that it's not appropriated money and that it should be handled differently (than through legislative ap- propriation)," Nielsen said. "We are feeling our way with the Department of Finance on that issue right now, and there is no question we will have to jump through hoops and make a proper accounting of it."
