The Bountiful Republican said the governor had decided to veto bills because he disagreed with them philisophically, where previous governors had exercised veto powers only when a proposed law had constitutional problems or threatened the public good. "The adoption of an 'activist' veto policy by your office is a decision which I fear will provoke unnecessary contention between the executive and the legislature, just as there has been a strong reaction both publicly and in the legislature itself against judges who use their powers to 'legislate' public policy," Irvine wrote. "The philosophy of public policy has historically been the province of the legislature, and the magnitude of the recent executive incursion is disturbing," he said. Matheson axed Irvin's bill, saying he believed it would lead to less diligence and sloppy preparation by prosecutors. "Your message," replied Irvine, "ignores the fact that the present statute prevents even the most competent and best prepared prosecutor from appealing an arbitrary ruling by a trial judge who may grant a dismissal over a question of whether a defendant's own confession of guilt may be received into evidence." The lawmaker termed the veto an "insult" to the state' prosecutors, who requested the bill. Under state law, a convicted criminal has dozens of possible appeals. But prosecutors who lose get a second chance in only a handful of circumstances.
