(UPIl The removal of bullet fragments from the body of a murder suspect for use as evidence against him was a violation of his rights, the Indiana Supreme Court has ruled. The high court, by a 2 margin, overturned the life sentence of Harry Adams, convicted on a murder charge stemming from the slaying of Marion County Sheriff's Lt. Jimmie Wingate during a 1970 Indianapolis supermarket holdup. The court granted Adams a new trial. Three bandits were involved in the holdup and one of them was killed in addition to the policeman. Another bandit, later identified as Adams, was wounded. A tip from an informer led police to Adams, w ho was found to have bullet wounds in the hip and buttocks. Under a court order the bullet fragments were surgically removed and expert witnesses later testified that the bulks came from the slain ' policeman's gun. The majority opinion by the Supreme Court said the removal of the fragments was a violation of the 14th Amendment to the U.S. Constitution. The majority said the removal of the fragments was "an intrusion of the most serious magnitude. We hold that the 14th Amendment prohibits the type of intrusion within the body of the suspect as occurred in this 3-- case." Chief Justice Norman Arter-buiwrote the opinion and Justices Donald Hunter and bvuiuiti vuittui vu U4Uta new trial should be granted. DeBruler. however, said he thought the trial court erred in another matter, but not in the question of removing he bullets. ii DeBruler questioned the credibility of the informer who led police to Adams in the first place. Justices Dixon W. Prentice and Richard M. Givan dissented, saying the surgery was not major and should not be considered "of the most serious magnitude." They said it might be another question if major surgery were involved, such as open heart or brain surgery. Likewise, the study notes, the high command of the North Vietnamese Army is still in the hands of the same men who made the decisions at the time of the 1354 battle of Dien Bien Phu. which resulted in French withdrawal from Indochina.
