Utah Church Tax Exempt Claims May Go to Court A SALT LAKE CITY (UPI) legal opinion from Salt Lake County Attorney Carl Nemelka may throw the cases of nonprofit organizations property tax exemptions into the courts. Nemelka said Monday that appeals now being heard by the county commission should be decided instead by judges, because the cases raise constitutional questions. The county assessor recently added a number of previously seeking authority in the law for either the county commission or the state tax commission to exempt property once it has been placed on the tax rolls. "After the county assessor determines that property should be put on the tax rolls, it becomes a constitutional question," Nemelka said, "and it is our belief that constitutional questions must be decided by the courts."
