Indictment charging: Gus Branch, pool hall proprietor of Truckee, with the murder of Mrs. Annie Boyle, was dismissed hero Thursday on motion of the district attorney. He stated that the report of the autopsy at Ogden, Utah, which led to the indictment, was discredited by Dr. Frank Bartlett, one of the physicians' present, who, was positive death was due to other causes than the beatins alleged in the indictment. Mrs. Boyle died at Truckee in .and the autopsy early was askedNovember, by her mother, who had the' body disinterred at Ogrden. PHYSICIAN EXriiAIXS. Dr. Bartlett today said that the facts as contained In the autopsy report had apparently been misinter preted by authorities in Nevada City ond. they went ahead with the indict-jnedepending; upon the result of the autopsy held here for evidence Vfith which to try Branch for murder, t. He said that while the autopsy report showed that the woman was brubeaten before her death, it also tallyforth set that the beating had not caueed death. The finding: of poison in the woman's stomach, when the mucous membrane of the throat showed no burns, he said, migrht have come as a result of the woman swallowing water directly after taking the , to show that murder was committed. Local authorities say that dismissal of the charges against Branch Q does not clear up the reason for the severe beating the woman apparently underwent immediately preceding her death. It was brought out at the autopsy here that the woman's body was covr ered with bruises and gashes were found in her scalp, evidently caused f by a blunt instrument. GAMBLING CHARGES Jim KarasfcJ.
