The terms are substantially as follows : First, to immediately return to us the fhip "Virginius" and all surviving and crew. Second, to salute our flag on the 25th of next December, unless in the meantime Spain shall satisfy us that the American flag was improperly borne on that vessel; and, further, that she had no right to the American flag, or American papers. In this event the salute is to be spontaneously withdrawn, and disclaim is to Spain any intentformally ion at indignity to the flag in the acts committed by spain agaiuit the "VirA put-bac- k. pas-enge- rs ginius." Third, if it shall thus be shown that the "Virginius" had no right lo convey the American flag and papers the United States will institute proceedings against the vessel and surviving parties, who have viola ed the laws of the United Slates, and Spain guarantees to institute proceedings against her authorities who have violated either the law or treaty stipulation. Fourth, the reclamation for damages is reserved for future confide ration. Within the next two days Secrotary Fish and the Spanish minister will determine the port at which the "Virgiuius" and her surviving aud crew shall be delivered to. The words "immedia;e of release," as applied to the "Virgiuius" and her surviving passengers and crew, implies, of course, reasonable time for its execution, as some days must elapse before Havana and Santiago de Cuoa can be reached. The latter consideration is not a one, but the condition of my health is such a. to lead me to seriously doubt my strength to discharge the arduous duties of a Senator from California. The Railway Xetcs, English organ of the Erie Company, publishes a proposal million more for an issue of twenty-tw- o ordinary Erie shares of 85 cents currency, instead of issuing bonds. This proposal, the A'etrj says, will be a measure of the greatest financial soundness, and will make the total shares of capital stock one hundred million, which is net too large when the vast amount of lines now leased by the Erie Company is taken into consideration. By an aecideut this morning on the Midland road, near Leicester, fifteen persons were injured, one mortally. Madrid, 9. The Spanish cabinet has agreed to deliver to lue U. S. Government the steamship "Virginius" and all persons remaining alive who were captured with her, leaving the question as to whether the seizure of the vessel was legal, to be settled hereafter by a mixed tribunal. The question whether damages shall be paid to the families or relatives of the men who were shot, is also to be settled in a similar manner. This decision was not arrived at by the Government before it had confidentially consulted with the powers of Europe, and was informed by all of them that reparation was due for the capture of the Bteamer and the execution of the captives. The decision is also in conformity with the opinion of leading Spanish statesmen of all parties, to whom the question was submitted by Government.
