Any cardboard or heavy paper cone (cone fountain) containing up to 50 grams of pyrotechnic composition which produces a shower of color and sparks upon ignition and may whistle or pop ; c. tube Any cylindrical (illuminating torch) containing up to 100 grams of pyrotechnic composition which produces colored fire upon ignition; d. Any pyrotechnic device (wheel) capable of being attached to a post or tree containing up to six "driver" units or tubes not exceeding Vt" in inside diameter that each contains not more than 60 grams of pyrotechnic composition per driver unit which revolves upon ignition producing a shower of color and sparks and sometimes a whistling effect; e. Any device similar in design and effect to a "wheel" capable of being placed on the ground (ground spinner) and ignited; and f . Any narrow paper fuseless tube (flitter sparkler) filled with that composition pyrotechnic produces color and sparks when the popper at one end of the tube is ignited. "Ground audible device" 3) means any paper or cardboard tube containing not more than 50 milligrams of pyrotechnic material that travels along the ground (chaser) upon ignition and often produces a whistling andor popping effect fireworks "Combination 4) device device" means any containing combinations of two or more of the effects described in subsections (2) or (3) . 5) "Trick noisemaker" means: a. Any tube or sphere containing pyrotechnic composition that upon ignition produces white or colored smoke (smoke device) as its primary effect; and b. Any device that produces a small report intended to surprise the user, including: (i) A "booby trap" which is a small tube with a string protruding from both ends that ignites the friction sensitive composition in the tube when the string is pulled; (ii) A "snapper" which is a d device small containing a minute quantity of explosive composition coated on bits of sand which explodes producing a small report; (iii) a "trick match" which is a kitchen or book match coated with a small quantity of explosive or that composition pyrotechnic produces a small shower of sparks when ignited; (iv) A "cigarette load" which is a small wooden peg coated with a small quantity of explosive composition that produces a small report when the cigarette is ignited ; and (v) An "auto burglar alarm" which is a tube which contains pyrotechnic composition that produces a loud whistle and smoke when ignited. A small quantity of explosive, not exceeding 50 milligrams, may also be used to produce a small report. A squib is used to ignite the device.' B. It is unlawful for any person to sell or offer for retail sale, or to discharge any fireworks in Midvale City other than those defined in subsection A (2) to (5). Furthermore, it is unlawful for any person under the age of sixteen years to purchase or discharge fireworks which are otherwise lawful under this section. C. Fireworks sold or offered for sale in violation of this chapter may be seized and destroyed and the license of the person selling or offering fireworks for sale may be revoked. D. Fireworks may be sold on or between June 20 and July 25; on or between December 20 and January 2; and 15 days before and on the Chinese New Year. E. Fireworks may be discharged three days prior to, on the day of, and three days following July 4, July 24, January 1, and the Chinese New Year. F. This chapter does not apply to the product inventories of fireworks manufacturers, importers, wholesalers or distributors designated for shipment directly out of the state. G. Any person who sells at retail fireworks other than those listed in section A (2) through (5) above is guilty of a class B misdemeanor. H. Any person holding a proper business license to sell fireworks pursuant to this section shall conform to the following requirements: (1) The Fire Chief of the City may determine or regulate the location of fireworks sales, in accordance with this ordinance. (2) No person shall engage in any type of retail, class "C" fireworks sales, storage or handling without first having submitted an application for and obtained a business license from the City. Annual fees for issuance of such license shall be $300.00 for each sales outlet within the city. Such license shall be issued for one calendar year, and shall be subject to all other ordinances relating to business licensing not incompatible herewith. (3) Persons selling fireworks shall be 16 years of age or older. A salesperson shall remain at the sales location at all times when open to the locking public unless suitable devices are provided to prevent unauthorized access to the merchandise by others, or unless the merchandise is removed. (4) In all retail sales locations, the area where fireworks are displayed or stored shall be at least 50 feet from any flammable liquid or gas,' or other combustible highly material. (5) Buildings and temporary stands for the retail sales of fireworks shall be constructed on hard surfaced areas in compliance with local regulations, or if none, in accordance with nationally recognized good practice. Fifteen compete for crowns the fifteen young ladies entered in this year s Miss Western Stampede Pageant only two will ride away on the evening of July 4 wearing the tiaras of Queen and Princess. Six other beauties will claim the first, second and third runnerup Of titles. The doesn't competition officially start until June 29 for the Queens and June 30 for the contestants with Princess crowning the evening of July 4, prior to the P.R.C.A. Rodeo Finals. Since each girl knows she will be judged on her ability to handle her horse in any given situation and her form while mounted, a considerable amount of time is spent training herself and her animal. Time must also be spent on her appearance because a great part of her competition tally depends on her color coordination and fit of her western attire, accessories and makeup. In addition, the knowledge of the sport of rodeo, poise in front of judges and audience while answering questions, making speeches, modeling and parade appearances and you have 15 young ladies with not much else on their minds except perfecting themselves. All of this time spent brings 8 girls a step closer to representing West Jordan's Western Stampede throughout the coming year. Public Notice ORDINANCE NO. AN ORDINANCE AMENDING THE MIDVALE CITY CODE PERTAINING TO FIREWORKS BE IT ORDAINED BY THE MIDVALE CITY MUNICIPAL MIDVALE CITY, COUNCIL, UTAH, AS FOLLOWS: SECTION I Section of the Midvale City Code pertaining to Fireworks be amended to read as follows : That 13-3- 4 Certain Fireworks Section Prohibited. A. As used in this section: 1) "Firework" means any composition or device manufactured or used for the purpose of producing a effect by visible or audible or combustion, deflagration, detonation but does not include model rockets, toy pistol caps, emergency signal flares, snakes or glow worms, party poppers, wire sparklers under 36 inches in length, matches, or class A and B explosives. (20) Hours of operation shall be restricted to the hours of 8:00 o'clock a.m. to 9:00 o'clock p.m., in temporary stands only. Each licensee shall be (21) required to have in force and to show proof of personal and property and public liability insurance in the amount of $100,000$300,000 setting forth the city as a named insured. (22) Each license shall be required to post a cash bond with the City in the sum of $1,000 for each sales stand to insure prompt removal and cleanup after each sales season. (23) Severability clause. If any part of the ordinances of this chapter or the application thereof to any person or circumstances shall for any reason be adjudged by a court of to be competent jurisdiction unconstitutional or invalid, such judgment shall not affect, impair or invalidate the remainer of this ordinance or the application thereof to other persons and circumstances, but shall be confined in its operation to the section, subdivision, sentence or part of the section and the persons and the circumstances directly involved in the controversy in which such judgment shall have been rendered. It is hereby declared to be the intent of the governing body that this section would have been adopted if such invalid section, provision, subdivision, sentence or part of the section or application had not been included. SECTION II In the opinion of Midvale City Municipal Council, it is necessary to the peace, health and safety of the inhabitants of Midvale City that this become effective Ordinance immediately upon its first publication and filing of a copy thereof in the office of the City Recorder of Midvale City, Utah. SECTION III This Ordinance shall take effect upon the first publication and filing of copy thereof in the City Recorder of Midvale City, Utah. (12) Each temporary stand shall have a minimum of two, 3'0" wide x 6'8" high, exit doors, which swing out at opposite ends of the stand. Door locking devices, if any, shall be easily released from the inside without special knowledge, key, or effort. (13) Each stand shall have a minimum 3' wide unobstructed aisle, running the length of the stand, inside and behind the counter. ( 14) The pass through openings for sales of fireworks in stands shall be arranged to permit the customer to view the merchandise for sale but prevent the touching or handling of fireworks by the customer. (15) Temporary stands for the sale of fireworks shall be located in properly zoned areas, at least 25 feet from other buildings or vehicles, 100 feet from other fireworks stands, 35 feet from flammable liquid or gas storage and dispensing units, and 10 feet from a public street, sidewalk or property line.
