Show THE SENTINEL Public Notice ORDINANCE NO. AN ORDINANCE OF RIVERTON CITY, UTAH PROVIDING FOR THE PURCHASE OF SUPPLIES, MATERIALS, EQUIPMENT AND CONTRACTUAL SERVICES. Be It Ordained By The Riverton City Council That of the Code of revised ordinance of Chapter Riverton City be amended to read as follows and that ordinance numbers Part be repealed. and ESTABLISHMENT PROVISIONS and other perPursuant to Sections tinent provisions of the laws of the State of Utah, there is hereby adopted and established a Purchasing System for Riverton City. 10-8-- Part Definitions Unless the context requires otherwise, the terms as used in this ordinance, or the rules and regulations adopted pursuant to this ordinance shall have the following meanings : (a) "Supplies", "Materials" and "Equipment" -all articles or things which shall be furnished and any to or used by any City department. (b) "Contractual Services" public works protects and other professional services such as auditing, architects, engineers or other consulting services. (c) "Bidding" - procedure used to solicit quotations on price and delivery from various prospective suppliers of supplies, equipment, and contractual services. (d) "Responsible Bid" an offer, submitted by a responsible bidder to furnish supples, equipment or contractual services in conformity with the specification, delivery terms and conditions and other requirements included in the invitation for bids. (e) "Responsible Bidder" - a bidder who submits a responsible bid; who has furnished, when requested, information and data to prove that his financial resources, production or service facilities, service reputation and experience are adequate to make satisfactory delivery of the supplies, equipment, or contractual services on which he bids; and who has not violated or attempted to violate any provisions of this ordinance. (f) "Local Bidder" a firm or individual who regularly maintains a place of business and transacts business in, or maintains an inventory of merchandise for sale in, or is licensed by, or pay business taxes in Riverton City. (g) "Estimates of Requirements" forecasts of future requirements of supplies, equipment, or contractual services submitted by Department Heads. standard forms used by (h) "Requistions" departments providing detailed information as to quantity, description, estimated price, recommended supplier, and signature authorization for requested purchases. (i) "Purchase Orders" official document used in committing City funds toward the purchase of supplies, equipment and contractual services. (j) "Adequate Appropriation Balance" sufficient fund balance which must exist in the line item appropriation of the account number against which the purchase order is to be charged. (k) "Public Property" any item of real or personal property owned by the City. (1) "Department Head" the City Councilman who administers a department or his designate as specified in writing to the purchasing agent or in the absence of a Department bead the City Manager. The form and amount of said bond shall be described in the notice invitingbids. (b) OPEN MARKET PROCEDURE . (l) Purchases of supplies, equipment or contractual services of an estimated value in the amount of $2,000.00 to $7,998.00, may be made tat he open market pursuant to the procedure hereinafter (c) PROFESSIONAL SERVICE CONTRACT PROCEDURE Contracts for professional services shall be awarded at the discretion of the Riverton City Council to Atinclude, but not limited to, the following services: torney, auditing, banking, insurance, engineering, architects. (3) Purchases of supplies, equipment, or contractual services of an estimated value inthe amount of $50.00 or less shall be made in the open market, bids by the Department Head, without solicitation. G City Council. (d) PURCHASE AUTHORIZATION OF SINGLE VEHICLES BY . Notwithstanding the requirements hereinabove contained, the City Manager, after the approval of the Riverton City Council, may make a purchase of a single motor vehicle without using either the formal contract procedure or the open market procedure. In lieu of such procedures, the City Manager shall obtain from at least three competitors, telephone bids. Having obtained such bids, the City Manager may accept the vehicle subject only to ratification by the City Council at the next regular Council meeting. EXEMPTIONS TO COMPETITIVE BIDPart DING REQUIREMENTS Contracts which by their nature are not adapted to award by competitive bidding, such as contracts for items which may only be purchased from a single source, contracts for additions to and repairs and maintenance of requipment owned by the City which may be more efficiently added to, repaired or maintained by a certain person or firm, contract for equipment which, by reason of the training of the personnel of or an inventory of replacement parts maintained by the City is compatible with the existing equipment owned by the City shall not be subject to the competitive bidding requirements of this ordinance. INTERLOCAL AGREEMENT IN LETPart TING OF CONTRACT FOR COMMODITIES OR SERVICES The City shall have the power to enter into joint purchase agreements with any or all other public agencies within the state for the purchase of any commodity or service wherein it is determined by the City Council to be in the best interest of the City. PENALTIES Part (a) Conflicts of Interest. No member of the City Council or City employee may be interested direclty or indirectly in any contract entered into by the City. A violation of this provision shall be cause for removal or other disciplinary action. 70 (Mm Thursday, Mar (b) Collusion Among Bidders. Any agreement or collusion among bidders or prospective bidders is restraint of freedom of competition by agreement to bid a fixed price, or otherwise, shall render the bids of such bidders void. (c) Advance Disclosures. Any disclosure in advance of the opening of bids, whether in response to advertising or an informal request for bids, made or permitted Toy a member of the City Council or City employee shall render void the advertisement or request for bids. (d) Gratuities. The acceptance of any gratuity in the form of cash, merchandise or any other thing of value by an official or employee of the City from any vendor or contractor, snail be deemed to be a violation of this Ordinance and shall be cause for removal or other disciplinary action. SEVERABILITY Part If any section, subsection, subdivision, sentence, clause or phrase of this ordinance is for any reason nek) to be unconstitutional or otherwise invalid, it shall not affect the validity of the entire ordinance or any of the remaining portions hereof. The City Council hereby declares that it would have passed this Ordinance, and each section, subsection, subdivision, sentence, clause and phrase hereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses or phrases be declared unconstitutional or otherwise invalid. REPEALS Part All ordinances or resolutions of Riverton City which may be inconsistant with this ordinance are hereby repealed. This Ordinance shall become effective immediately upon posting. THEREFORE, NOW, BE IT ORDAINED: By the City Council of Riverton City that the position of City Manager shall receive a salary amounting to $300.00 per month and such other benefits as may be provided for employees of Riverton City under the Riverton City Personnel Policies. THE CITY COUNCIL OF WHEREAS, Riverton RIVERTON ESTABLISHING CITY THE ATTEST: s Sandra Lloyd City has created the City Recorder (Pub. position of City Manager V2B ADMINISTRATION The City Manager shall act as the City purchasing agent. The City Manager shall have the authority and it shall be his duty to perform except as limited by subsequent sections of this ordinance; the following: (a) Administer and maintain the purchasing system and other rules ana regulations esuDiisnea by this chapter and its authority. (b) Recommend to the City such new or revised purchasing rules and regulations as desirable and in conformance with other statutory requirements, and to interpret the provisions of this chapter and applicable statutes. (c) Negotiate and recommend execution of contracts for the purchase of supplies, equipment and contractual services. (d) Seek to obtain as full and open competition as possible on all purchases. (e) Keep Informed of current developments in the field of purchasing, i.e. prices, market conditions, new products, etc. (f) Prescribe and maintain such forms as reasonably necessary to the operation of this ordinance and other rules and regulations. (g) Supervise the inspection of all supplies and to assure . conformance with equipment specifications. (h) Maintain a Bidders' List, Vendors' Catalog file and other records needed for the efficient operration of the Purchasing System. BIDDING COMPETITIVE Part REQUIREMENTS Except as hereinafter provided, purchases of supplies, equipment, and letting of contracts shall follow one of the following procedures: (a) FORMAL CONTRACT PROCEDURE Except as otherwise provided herein, purchases of supplies, equipment or contractual services of an estimated value greater than $7,999.00, shall be by written contract with the lowest responsible bidder pursuant to the procedure hereinafter prescribed. (1) Approval of Specifications. Prior to seeking bids for equipment or contractual services having aunit cost in excess of 87,999.00, action of the City Council shall be required to approve specifications and to authorize advertising for bids. (2) Notice Inviting Bids. Notice inviting bids shall include a general description of the articles to be purchased, shall state where bid blanks and specifications may be secured, and the time and place for opening bids. All bid openings will occur after 2:00 p.m. on bid opening date. a) Published Notice. Notices inviting bids shall be published at least five days before the date of the opening of the bids. Notices shall be published at least once in a newspaper of general circulation distributed in the City. b) Bidders' List Sealed bids shall be solicited from all responsible prospective suppliers whose names are on the Bidders List or who have made written request that their names be added thereto. c) Posted. Notices advertising pending purchases shall also be posted in the City Hall. (3) Bid Opening Procedure.
