The notice shall provide for a period of fifteen days in which the owner shall pay the total unpaid balance of the Assessment together with costs and interest on the entire unpaid balance to accrue from the date of delinquency at the Delinquent Rate. Assessment Area shall become incontestable as to all persons who have not commenced the action provided for in the Assessment Resolution; and (b) a suit to enjoin the issuance or payment of the Bonds or refunding bonds, the levy, collection or enforcement of the Assessment, or to attack or question in any way the legality of the Bonds or refunding bonds or the Assessment may not be commenced, and a court may not inquire into those matters. After notice has been given as provided, the District may commence foreclosure proceedings in the manner provided for actions to foreclose trust deeds; provided, however, if an owner has not consented to a foreclosure proceeding described in Title 57, Chapter 1, Conveyances of the Utah Code, the District may commence foreclosure proceedings as provided or permitted by Utah law. If at the sale no person or entity shall bid and pay the District the amount due on the Assessment plus interest and costs, the property shall be deemed sold to the District for these amounts. The District shall be permitted to bid at the sale. NOTICE IS FURTHER GIVEN pursuant to the Act that on July 17, 2017, the Board adopted a Resolution (the “Bond Resolution”) authorizing and approving the issuance of the Districtʼs special assessment bonds (the “Bonds”), in the aggregate principal amount of not to exceed TwentyEight Million Three Hundred Thousand Dollars, to mature in not more than twenty-two years from their date or dates, to bear interest at a rate of not more than nine percent per annum and to be sold at a discount from par of five percent. The Bonds are to be issued for the purpose of (i) financing the cost of acquisition and construction of the Improvements and (ii) pay certain costs of issuance of the Bonds. LEGALS The remedies provided for the collection of Assessments and the enforcement of liens shall include the remedies provided for collection of property taxes under Title 59, Chapter 2, Utah Code Annotated 1953, as amended. The amounts of accrued interest and all costs of collection shall be added to the amount of the Assessment up to the date of foreclosure sale. If (a) prior to the final date that payment may be legally made under a final sale or foreclosure of property to collect delinquent Assessment installments or (b) the end of the three-month reinstatement period, if collection is enforced through the method of foreclosing trust deeds, the property owner pays the full amount of all unpaid installments that are past due and delinquent with costs and interest on the entire unpaid balance to accrue form the date of delinquency at the Delinquent Rate, said owner shall be restored so that the owner will have the right to make the payments in installments as if the default had not occurred. The Assessment, or any part or installment of it, and interest accruing and the penalties and costs of collection shall constitute a lien against the property upon which the Assessment is levied on the effective date of the Assessment Resolution. Said lien shall be superior to the lien of any trust deed, mortgage, mechanicʼs or materialmanʼs lien or other encumbrance and shall be equal to and on a parity with the lien for general property taxes. The lien shall apply without interruption, change in priority, or alteration in any manner to any reduced payment obligation and shall continue until the Assessments, reduced payment obligations, and any interest, penalties and costs on it are paid, notwithstanding any sale of the property for or on account of a delinquent general property tax, special tax or other assessment or the issuance of a tax deed, an assignment of interest by the District or a sheriffʼs certificate of sale or deed. Any action must be commenced and summons must be served on the District not later than 60 days after the publication of this notice. Such action shall be the exclusive remedy of any aggrieved party. No court shall entertain any complaint that the party was authorized to make by statute but did not timely make or any complaint that does not go to the equity or justice of the Assessment or proceeding. After the expiration of the 60-day period provided in this notice: (a) the Bonds and any bonds issued to refund the Bonds and the Assessment levied in the Assessment Area shall become incontestable as to all persons who have not commenced the action provided for in the Assessment Resolution; and (b) a suit to enjoin the issuance or payment of the Bonds or refunding bonds, the levy, collection or enforcement of The Bonds are to be issued and sold pursuant to the provisions of the Act and pursuant to the terms of a resolution (the “Bond Resolution”) adopted by the Board on July 17, 2017. The Bonds are special obligations of the District payable solely from and secured solely by the Assessments, and the moneys in the funds and accounts held under and pledged therefor in the Bond Resolution. The Bonds are to be issued in such form and with such changes thereto as the District shall approve upon the adoption thereof, provided that the principal amount, interest rate or rates, maturity and discount, if any, will not exceed the respective maximums described above.
