Moving the POA office from Lois Oliver’s house to the community lot was discussed. Ray will estimate the cost of a cinderblock building once its size and specs. are given to him. Merrill Brady is also finding the cost of TOWN COUNCIL NOTES —MAY 8, 1996 MEETING Members present: Mayor Valli prohibited. Another amendment to the zoning 0rd. was adopted changing the use of temporary dwellings in CV. Residents may continue to use mobile vehicles such as RV’s. trailers. and other campers as tempory dwellings. but structures must now have a building Smouse, Pat Drake. Joan Sangree suggested that the POA board coordinate any plans with the Community Lot Committee. If someone wants to later buil a larger house, they must sign a contract stating that they will decommission the first structure when Rimrock Lane asking them to retinn or replace the sign. There was considerable discussion as to how (or cost because of an agreement made with the Town of Castle Valley during the placement of the transfonner for the well. Rebecca stated that she would research possible rental spaces for the FDA office. Lois stated that the Town might be able to obtain a matching grant for the construction of any public building on the community lot. George suggested that then the FDA could lease space from the Town in such a structure. Concerning the survey of the culde-sac on Homestead Lane, Ray will meet with Floyd Stoughton on the needs of the fire department. The established turnaround will then be the de facto “legal description” of the culde-sac. A special members meeting will be announced to address the $20,000 transfer to the Town exclusively for road maintenance. Motion made by George and seconded by Ray. Vote was unammous. The special meeting will be at 10 am at the IDS Church on June lst provided we um schedule this time with Ron Drake. George will write the letter to the general membership and organize the mailing. Merrill Brady delivered a Road Committee Report: Valli roads has been reduced brig .000. TC Vacancy: Charlie Kulander was appointed to fill the remainder of Lois Oliver’s term. Much discussion on adoption of amendment to zoning ordinance allowing unlimited numbers of employees in home or premise occupations. Dave Wagstaff said that he thought a cap of 3 employees was a good compromise. Pat said she felt the original provision for home and premise occupations so that people could work out of their homes was good, but didn’t feel it should be opened up to outside employees. Lois felt that the criteria for evaluating impacts from home and premise occupations should be worked out before the amendment was passed. Dave suggested that the proposed amendment should specify impacts to the whole community instead ofjust nearby residents. Bruce Keeler reported that the Town attorney had told him that there could be problems if any specific number of employees were stated in the ordinance. Questions were raised concerning what the current zoning ordinance situation really was. Valli moved to adopt the amendment for unlimited numbers of employees, but motion died for lack of a second. Dave moved to table amendment until Planning Commission had developed criteria for assessing impacts. Pat seconded Motion passed. TC adopted Ordinance 96-5, emphasizing that short term rentals are not permitted. A definition of short term rental was adopted “Rental of property or improvements on property communication to the board. Two months ago alien was placed on his property regarding delinquent dues. Merrill stated that if the lien is not released in 30 days he and his lawyer will start legal litigation against the CVRR POA. Merrill feels that he is eligible but not required to be a dues paying member of the CVRR POA. He made some distinctions between the River Ranches and River Ranchos-- days to a person or persons not residing in the Town of Castle Valley. The short term rental of property as defined herein is a commercial use of property.” Another section was added to the zoning ordinance specifiwa namely the two different sales units of stating that short term rentals are for a period of less than twenty-five if) this amendment meshed into the existing zoning ordinance. It was stated that there will now be no time limit on how long someone an occupy a temporary dwelling. Jayne Smythe moved to adopt, Pat seconded; passed unanimously. Lengthy discussion about adopting a 6 month moratorium on any new B&B’s. It was reported that there was substantial community support for limiting the number of B&B's. Some residents were concerned about businesses that brought non-residents into the community. It was pointed out that the moratorium would not affect the existing B&.B (Castle Valley Inn). Merrill Brady suggested that the moratorium should extend to all conditional use applications. Bruce Keeler concurred saying that much work needed to be done to the conditional use section of the zoning ordinance and that the moratorium would give the PC and TC time to do it. Moratorium 0rd. was changed from specifically affecting B&B’s to halting all new conditional use permit applications. Valli moved to adopt moratorium suspending all conditional use permits for 6 months; Jayne seconded; passed unanimously. Much discussion on proposed Town budget for next year. (Last year the CV Times printed budgets for Town and POA—will do same again if available.) Some highlights: Anticipated income of ~$ 12,000 from Class “C” road fund and ~$10,000 from State sales tax disbursments. FDA is asking members about allocating $20,000 to Town for road work. Valli asked TC members to write questions that they felt should be sent out in several “mini-surveys” that could happen as soon as early summer. TC needs to find how community feels about B&B's, commercial development, and other issues before TC and PC. —Jack Campbell |
