That said special taxes and assessments shall be payable in ten equal annual installments on or before the first day of April in each year commencing in the year 1956, with interest from the effective date of this Ordinance, i. e., the date of publication thereof, on the whole Mm unpaid at the rate of four per annum, unper centum til due, payable at the time each installment is due. Both principal and interest are payable at the onice of the City Treasurer, Lehi, utaii. One or more of such instalments in the order payable, or tne whole tax, may be paid without interest within fifteen days alter this ordinance, becomes effective. Failure to pay the whole tax and assessment within said period of fifteen days shall be conclusively considered and held an election on the part of all perwhether under sons interested, disability or otherwise, to pay the unpaid tax and assessment in such installments. One or more installments in the order in which they are payable, or the whole special tax, may be paid after said fifteen days and before the first installment become due by paying the same with interest from the date of levy to the date such first installment is due. One or more installments in the order in which they are made payable, or the whole special tax, may be paid on the day any installment becomes due by paying the amount thereof arid interest to the date of payment. Default in the payment of any such installment or the whole of the unpaid principal or interest to become due and and the payable immediately, whole amount of the unpaid principal thereafter draw interest at the rate of ten per centum per annum until, paid; but at any time prior to the date of sale or foreclosure, the owner may pay the amount of all unpaid installments past due, with interest at the rate of ten per centum (10) per annum to date of payment on the delinquent installments, and all accrued costs, and shall thereupon be restored to the right thereafter to pay in installments in the same manner as if default had not occurred. In case any such tax shall become delinquent, and the property subject thereto shall be sold to said City therefor, no redemption of such property shall be permitted except upon payment of the full amount due, interest and taxes paid by said City and accrued costs and redemption fees, unless in the judgment of the City Council of said City the in terest of the City will be sub served by accepting a less sum m settlement therefor. After sale, if tax sale certificates thereon have issued to the City, such City may provide by ordinance for payment in installments of unpaid principal, interest and all costs and charges, and for giving credit for the amounts so paid against the amounts so due; provided, that the installment shall be in such amount as will discharge the within not more indebtedness than the period in which the right to redeem from such tax sale shall expire. Credit shall be given for each installment as paid, and interest thereby reduced proportionally, and on all unpaid installments interest shall be paid and charged at the rate of ten per centum (10) per annum. In case any owner electing to take advantage of the provisions of such ordinance shall fail to make payment of such installments when due, the right of the City to receive a tax deed for such real estate, shall not be impaired, nor shall the owner be entitled to receive any refund of any amounts paid. Such ordinance may also provide for the payment with each installment of a sum, not exceeding $1 per installment to cover the additional bookkeeping expense incured in connection therewith, and not to be credited against the delinquent tax. In case of deficiencies, omisions, errors or mistakes in making such assessment or levy in respect to the total cost of the improvement, the City Council shall make a supplemental assessment and levy to supply such deficiencies, omissions, errors or mistakes. Section 4. That the amounts assessed as aforesaid shall be a lien upon said lots and parcels of land from the date of publication of this ordinance, i.e. its effective date, piror and superior to all liens, claims, titles, mortgages, and encumbrances, except the liens of general taxes, pursuant to Section Utah Code Annotated, 1953, and all laws amend (4) (10) 9, City of Lehi and any other ordinances or resolutions, or parts thereof, in conflict with the provisions of this ordinance are hereby repealed. This repealer shall not be construed to revive any or part ordinance, resolution, thereof, heretofore repealed. Section 10. That after the is suance of bonds to defray the costs of said improvements, this ordinance shall be and remain ir- repealable until said bonds and the interest thereon shall be fully paid, certified and discharged, as herein provided. Section 11. That should the courts of this or any other State or of the United States declare any section, provision, paragraph, clause, sentence phrase, or part thereof, of this ordinance invalid, unauthorized or unconstitutional, or in conflict with any other section, provision, paragraph, clause, sentence, phrase, or part thereof. this ordinance, then sucli decision shall affect only the section, proe, vision, paragraph, clause, phrase or part thereof, declared to be invalid, unauthorized or unconstitutional, and shall not affect any other part of this ordinance whatsoever. The City Council of the said City hereby declares that it would have passed this ordinance on behalf of said City and each section, provision, p a r a g r ap h, clause, sentence, phrase, or part thereof, hereof, irrespective of the fact that any one or more of the sections, provisions, paragraphs, clauses, sentences, phrases, or parts thereof, be declared invalid, unauthorized or unconstitutional. Section 12. That it is necessary for the immediate preservation of the peace, health and safety of said City and the inhabitants thereof that this ordinance become effective immediately; an emergency is hereby declared; and this ordinance shall be in effect after its passage and approval, on the date of its publication. Section 13. That this ordinance shall be published once in the Lehi Free Press, a newspaper of circulation published general within said City. That in case any such lot or parcel of land so assessed is delinquent in the payment of such assessment or any installment of principal or interest, the City Council shall forthwith cause Lauren W. Gibbs, Salt Lake City, Utah, as representative of the holder or holders of the bonds to be hereafter authorized to be issued by ordinance for the purpose of defraying a portion of the cost of the improvements in said Curb, Gutter and Sidewalk Improvement District No. 3, and the owner of such delinquent property, if known, to be immediately notified in writing of such delinquency, and if such delinquency shall not be paid within ten days after such notice shall have been given, then said City Council, at its own expense, shall forthwith foreclose the special assessment lien against the property or properties wherein the delinquency exists in the method now or hereafter provided by Article 7, Chapter 1, Title 10, Utah Code Annotated, 1953, and all laws thereunto enabling, or as otherwise provided by law, and at such sale, if there be no other purchaser therefor, said property shall be bought by the City for not less than the amount of the balance due on the assessment, principal, interest, penalty and costs. If said foreclosure be not promptly filed and prosecuted, then any bondholder may file and prosecute said foreclosure action in the name of said City. Any bondholder may also proceed against the City to protect and enforce the rights of the bondholders under this ordinance by suit, action or special procedings in equity or at law, either for the appointment of a receiver or for the specific performance of any provision contained herein or in an award of execution of any Know Your power herein granted for the en UTAH VALLEY forcement of any proper legal or equitable remedy as such bondto holder or bondholders may deem most effectual to protect and en force the rights aforesaid.
