The legality of such a move became a question that the supreme court was called upon to settle- - By the decision of that court Lehi City was given the legal right to establish a municipal plant to provide electric energy for all the citizens of Lehi- This court decision is extensively quoted all over the United States. A contract was let to Fairbanks, Morse & Co. to install a 180 h. p. Diesel Engine and the necessary auxili ary machinery with a distributing system to cover the entire community for f42,373.00This was completed and accepted by the city government on February 10, 1930. To finance this investment the Fairbanks, Moorse & Co. through the Municiapl Acceptance Corp. of Chicago accepted seventy-tw- o of promissory notes $588.50 each, one of which was to be paid each month with interest. These payments were made monthly as re quired. On this issue $8,827.50 was paid by the power plant out of its revenues. Then it was decided by our city government that in order to make the plant really efficient and independent there shoud be sufficient stand-b- y equipment to provide a continuity of power in case of emergency and also to meet the growing demand for pow er, that another engine be installed and the system and switch board and plant building be remodeled. To accomplish this a contract was let to Fairbanks, Morse & Co. for 210 b. p. engine with all the necessary equipment included.
