That the City Council of Midvale City, Utah, does hereby levy a tax and provide for the assessment and collection of the same, upon all the real estate hereinafter described, and for the following purposes: For furnishing all of the material and doing all of the work, except the City's portion thereof, necessary to fully complete the construction of the concrete pavements, four feet wide by four inches thick, situate in Sidewalk District No. 5, in Midvale City, Utah, extending upon and over both sides of all streets hereinafter named, according to the plans, profiles, and specifications on file in the office of Edward B. Jones, City Engnieer, at Midvale City, Utah; and defray all costs and expenses thereof, including the cost of engineering, advertising and all other expenses therewith connected, except the City's portion; to be paid by local assessment upon the abutting lots, pieces and parcels of ground to be affected and benefited by said improvement, and hereinafter described. Sidewalk District No. 5, Midvale City, Utah, shall include all lots or pieces of ground on both sides of the streets fronting on or abutting and for all and the full depth of all lots back from the following streets: Jefferson Street-From a point 24 feet South of the North line of Lot 4, Block 3, Eastvale Addition, to the South line of Sixth Avenue. Lincoln Street-From the North line of Park Street to the South line of Sixth Avenue. Park Street-From the East line of Jefferson Street to the West line of Grant Street. Grant Street-From the South line of Lot 13, Block 1, Malstrom Subdivision, to the South line of Park Street. The City's portion of the said improvements, to be paid for from the General Fund ,is estimated at $127.00. The portion of said improvement to be paid for by local assessment is estimated at $6912.21. The tax before referred to is assessed on all real estate abutting the improvements before described, and for the full depth of each lot or portion, extending along ana by said improvements. Said tax is levied to defray the expenses of constructing the said curb and gutter, together with eveiJ1hing therewith connected, abutting the property hereinbefore described, and to be especially affected and benefited by said improvements; and it is hereby adjudged, determined and established all of said property abutting said improvements will be especially benefited thereby to the full amount of the tax hereby levied, and the said parcels of land are hereby assessed at a uniform rate of $1.00 per linear foot for the curb and gutter and $3.30 per linear foot for the 6-inch drives in accordance with the linear foot frontage upon said portions of said streets fronting or abutting upon said improvements, and to the full depth of all lots or portions affected. That the total cost of said improvements and the cost per linear front foot of said curb and gutter and drives is in accordance with the written contract entered in for the performance of said work by Midvale City with J. L. Griffth, dated the 29th day of July, 1930; and the Treasurer of Midvale City is hereby authorized and directed to assess and collect said taxes in accordance with the provisions of this Ordinance and with the law in such cases provided. Section 2. Said taxes shall become delinquent as follows: One-fifth of the total amount shall be delinquent in one year after the levy of such assessments is made; one-fifth of the amount shall be delinquent in two years after the levy of such assessments is made; one-fifth of the amount shall be delinquent in three years after the levy of such assessments is made; onefifth of the amount shall be delinquent in four years after the levy of such assessments is made; one-fifth of the amount shall be delinquent in five years after the leyy of such assessments is made. All said installments shall drawn interest at the rate of six per cent per annum from the time of levying the aforesaid tax until the same shall become delinquent, and after all of the installments before mentioned become delinquent, interest at the rate of 12 per cent per annum shall be paid thereon. In the event of any installment or the interest aforesaid not being paid on the date the same becomes due, the whole of the special tax unpaid at the time said installment and the interest thereon are due, shall become due and payable and shall bear interest at the rate of 12 per cent per annum until the sale of the property assessed; provided that one or more installments in the order in which they are payable, or the whole tax unpaid, may be paid on the date any installment becomes due by paying the amount thereof and the interest before said date. Section 3. This Ordinance shall take effect upon approval of the Mayor and one day after publication. Passed by the City Council of Midvale City on the 16th day o! I further testify that on the 18th day of December I had a full, true and correct copy of said ordinance printed In the Midvale Journal, a weekly paper published in Midvale City, Utah.
