These regulations discuss the "suffer or permit" concept which allows an employee who is not exempt from FLSA to be paid for all overtime work which management "suffers or permits" to be performed. In other words, any work performed prior to or after the established shift hours or during the prescribed lunch period by an employee covered by the FLSA for the benefit of the agency, whether requested or not, is working time if the manager or supervisor knows of or has reason to believe it is being performed. In such cases, managers must ensure that work is not performed when it is not needed and when they have not authorized it to be performed. However, employees who are exempt from FLSA cannot receive overtime payment for work which they have performed outside the scheduled duty hours unless it has been official-- , ly ordered and approved. These employees would not be restricted from coming in early and working through lunch, if they choose, and would suffer no consequence for doing so. There is nothing which precludes using the results of performance outside normal duty hours in appraising an exempt employee.
