Eleven One of the greatest proposition ever offered to citizens of southern Juab county is the proposed water project now under way by the leading people of L e v a n . These citizens are negotiating with the officers of the Deseret Irrigation Co. to have 11000 two acre feet of water pumped into Juab valley. A meeting was held at Levan and a committee, consisting of the following, D. Bosh, Lorenzo Mangelson, and S. P. Christensen, were chosen to the feesiblity of getting the water into the valley and and arrangments what could be made. This committee met with the president of the as-sert- ain terms Irrigation Company and discussed the proposition. Other Companies are also trying to make terms to get part of this water. The company is rather inclined to favor Juab county o w i n g to their good judgment of the possibility in this valley o v e r the others who are applying. Johnson came up for hearing Wednesday morning in the dis-tnct court, and the defendant was released onaccount of a defect in the complaint. While a new complaint was being made Johnson made good use of his freedom. He left the room and made his way down through the west part of town. When a new complaint was made the sheriff and his deputy got the direction he took, but was unable to find any trace of him after he passed the barn in the field, Alfred Lunt. A search was made all day for the man wanted for forgery, without lo cating him. When the shadow of darkness spread over mother earth. Sheriff Henriod took the Deputy sheriff's auto and went court to Juab. After ariiving at Juab the county sheriff went back a- ong the track to the Levan switch where he concealed him self. Only Twelve Hours Mrs. Allean Rowe met with an accident last Monday evening that might have proven to be much more serious than it really was. She and Mrs. Eliza Moly- neaux had been out for a drive and had stopped at J. W. Vest's store. Mrs. Rowe was left in the buggy to hold the horse, which apparently became frightened at a piece of paper and began run ning. She made a desperate ef fort to control the animal but with no avail. A very short turn was made just in front of the school house overturning the ve hicle and throwing Mrs. Rowe upon her head and shoulders. She was unconscious for several hours and received a number of ugly scratches on her face. P a i n t e r at Bingham, was brought to a close late last Sat urday night. After having been out from 10.30 a. m. to 10 o'clock n the evening the jury returned a verdict of voluntary manslaugh ter. The fact that the jury waa out so o n g without an agreement was taken as indicative of a controversy among the jurors as to the degree of verdict to return. The crime for which Rucker was tried was the killing of Geo. Painter at Bingham June 2, 1913. According to the evidence presented, Rucker climbed upon a horse which was being ridden in the canyon by Mrs. Zella Ay- rs and attempted to embrace her. the state presented eviden ce to the effect that Mrs. Ayers tent her companion for with the result that Mr. Ayers and Johnson responded. Then, according to the testimony, there was a fight in which Rucker was given a severe beatine. Later in the evening Rucker and his brother, it is claimed. met Painter, a relative of the Ayers, and tnere was a renewal of the fight which resulted in Ruker stabbing Painter in the neck, inflicting a fatal wound. The defence, represented by Attorneys Parley P. Jenson and Walker T. Gunter, presented evi dence to the effect that Rucker was badly beaten and maltreated ;y Ayers and Johnson at the time of the alleged insult to Mrs. Ayers, and later was cursed and antagonized by Painter. It was testified by Rucker and witnesses for the defense Painter struck Rucker several blows and thatU was in defense of himself that Rucker inflicted the wound which coat Painter his life. Herald. The district court of the fifth judicial district was commenced at Nephi Monday morning with Judge Joshua Greenwood on the bench and District Attorney E. II. Ryan representing the state. The case of W. L. Cook vs. Juab County Commissioners was the first case to occupy the attention of the court. The plaintiff asked for a writ of mandate to compel the commissioners to pay him for work done in the preliminary hearing in the case of the state vs Mathew Pay. The case came up for argument and was taken under advisement. The attorneys on both sides were given twenty d a y s in which to file briefs. The case of th state vs. Child Mantor was argued and a motion to the cane on the ground of lack of jurisdiction was also taken under advisement by the court. Tuesday the case of the stats vs Jos. Brindzach and also the case of thr state vs E. D. Snyder came before the court. A motion vas made by the defence to dis miss the case on the ground of ak of jurisdiction of the Silver Cit' justice of the peace.
