The territory to be annexed is contiguous to existing Vineyard boundaries and does not lie within the boundaries of another incorporated municipality. It was noted that the territory is accessible only through the streets of Vineyard and that Vineyard currently provides fire Council denies zone change, approves other permits By Jeanne Thayne Orem City Council overturned over-turned the Planning Commission's Com-mission's recommendation as well as city development staffs advice to rezone a narrow strip of land separating Palisade Park subdivision and Apple Ridge estates es-tates from RE-12 to R-l-8 at approximately ap-proximately 400 North and 1200 East. The motion, posed by Council Coun-cil member Lucile Steele, to deny the rezone request, passed in a 4-2 vote. "It was RE-12 and it should remain RE-12," said Steele. Her motion was supported by Kelvin Clayton, Jim Evans, and Joyce Johnson. Council members Keith Hunt and Norm Woodhouse opposed op-posed the motion. Developer Jim Smart said the four homes he planned would be a good transition and would not detract from the more expensive homes in Apple Ridge Estates . He said two lots would have 80 foot frontages, one 86, and the other 103 feet. The lots have a depth of 102 feet Smart showed slides of two homes he planned to build on the site and said the homes would sell for approximately $110,000 to $130,000. One home would be his own and the other is presold, t f - hi8 is a nice transition from the Apple Ridge estates to the rear with homes in the half million dollar range and those across the street in the $70- $80,000 range," he said. A fence would separate the two zones. , Apple Ridge residents, however, how-ever, fought the proposed zone change. "We bought here because of the higher zone," said David Lund. Orem's service agreement with Vineyard will not be affected by the annexation. A petition for the annexation has been signed by not less than a majority of the owners of real property representing more than one-third the value of the property proper-ty to be annexed. According to Ed Stout, Development Services director, the parcel to be annexed is located west of the current Vineyard City limits and includes some property under the lake. He said it appears the description of the property was inadvertently in-advertently omitted from the original incorporation documents. Orem City Council members questioned whether or not the City of Orem would be responsible respon-sible for service to this area and if it would require the city to in only way to be protected in Orem would be to be the last one to buy into an area." Some of the lots in Apple Ridge exceed 12,000 square feet. Lund said his home "would look right down on these homes." He said, "You can't build a fence high enough." Another Apple Ridge resident, resi-dent, Jared Blaser, said he was concerned about covenants and building standards and wanted the proposed homes to be built to RE-12 Zone's more restrictive covenants. Smart assured him that his homes would be attractive attrac-tive and well built and would enhance en-hance the area. If necessary, he said he would draw up covenants but they would have to conform to the proposed R-l-8 Zone. Smart told the council it is not practical for the parcel to be in an RE-12 Zone as the parcel is more closely tied to the homes it faces on the west than those that are across the back yard fence. He said he believed that is why it wasn't developed by the Apple Ridge developer in the first place. Jim Wilbur of the City Development Services department, depart-ment, said in a later interview that it may be difficult to construct con-struct homes on the site to the RE-12 code because of setback requirements. re-quirements. He said if the jparcel is divided into three narrow lots, there probably would be enough square footage to qualify, but he agrees with the current owner of ihe site that it probably isn't practical. prac-tical.
