NOTICE OF AUCTION SALE TO ALL INTERESTED PARTIES AND THEIR COUNSEL OF RECORD: Pursuant to the Debtor's and Stansbury Mining Corporation's Third Amended Joint Plan of Reorganization, dated August 25, 1987, as modified (the "Plan") confirmed by order dated September 4, 1997, and Bankruptcy Rules 2002 and 6004, the debtor deb-tor shall sell, by public auction, free and clear of leins, with such leins to be attached to the proceeds of the sale (the "Auction"), that certain real property described in Exhibits "A", "B" and "C", attached hereto and by this reference incorporated herein. General information regarding the terms and conditions condi-tions of the auction is as follows: GENERAL INFORMATION REGARDING THE AUCTION 1. By order dated September 4, 1987, the United States Bankruptcy Court for the District of Utah, Central Cen-tral Divsion, confirmed the Plan. 2. Pursuant to Article IV of the Plan, the debtor is required to sell, by public auction, that certain real property defined in the Plan as the Boardman Parcel, the Bow Valley Parcel and the Stables Parcel (the "Real Property Parcels"). The Boardman Parcel is described in Exhibit "A". The Bow Valley Parcel is described in Exhibit "B". The Stables Parcel is described in Exhibit "C". 3. The debtor shall sell the Real Property Parcels free and clear of liens, with such liens to attach to the proceeds of the sale. AUCTION TERMS AND PROCEDURES 1. The Auction shall be held on January 26, 1988, beginning at 2:00 p.m., in Room 341, United States Courthouse, 350 South Main, Salt Lake City, Utah 84101. The Auction Shall be conducted by the debtor or the debtor's authorized agent(s). 2. The Boardman Parcel, the Bow Valley Parcel and the Stables Parcel each shall be sold as a separate lot. 3. All parties holding all allowed secured claim within the meaning of 11 U.S.C. 506 ("Allowed Secured Claim") shall be entitled to credit bid its claim pursuant to 11 U.S.C. 363 (K) ("Credit Bid"). 4. In order for a party to bid at the Auction, he must either (a) Credit Bid its Allowed Secured Claim, or (b) deposit with the debtor the amount of $25,000 in cash, cashier's check or certified funds prior to the commencement of the bidding. Upon the final deter-mintation deter-mintation of the successful purchaser, all deposits received from parties who are not the successful purchaser pur-chaser will be refunded. 5. All sales shall be paid either by credit Bid andor cash, cashier's check or certified funds payable to the debtor not more than three business days after the close of the auction. In the event the highest bidder fails to timely pay, that purchaser's deposit shall be forfeited to the debtor and the debtor deb-tor will allow the next highest bidder, if any, three business days in which to perform. 6.
