HI LEGAL HOTICE ORDINANCE NO. 416 AN ORDINANCE ESTABLISHING ES-TABLISHING STANDARDS STAN-DARDS AND A PROCEDURE PRO-CEDURE FOR THE MOVEMENT OF ANY EXISTING STRUCTURE INTO OR WITHIN THE CITY AND PROVIDING CRIMINAL PENALTIES AND A BOND FORE-FEITURE FORE-FEITURE D7 THE STAN-DARDS STAN-DARDS AND PROCEDURES ARE NOT STRICTLY ADHERED AD-HERED TO. WHEREAS the City Council and staff of the City have become concerned con-cerned with the physical condition of structures and particularly homes that are moved into the City or are moved from one lot in the City to another; and WHEREAS the City Council has determined that some or all of the structures may constitute a hazard to the health and welfare of the persons who may occupy or use such structures as well as those whose interests may be affected by the use of such buildings; and WHEREAS the City Council has determined that, in order to ensure the health and welfare of all of the citizens of the City, it is necessary to require that all such structures and the sites on which they are located shall comply with the City's codes concerning building standards, zoning, etc.; and WHEREAS the City Council now desires to establish standards and a procedure for the movement move-ment of any such structures struc-tures into or within the City and to provide criminal penalties and a bond forfeiture for violation vio-lation of the terms of this ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OREM, UTAH: A. Section 28-288 (C) of the Orem City Code is hereby repealed and Section 28-288 (D) is hereby here-by reenacted as Section 28-288 (C). B. Section 28-343 of the Orem City Code is hereby enacted as follows: 1. No house, building or other structures of any kind shall be brought into the City nor shall any house, building or other structure be moved from one lot in the City to another lot within or outside out-side the City until all of the following conditions have been met: a. If the home, building build-ing or structure is to be moved to a lot in the City, the person desiring to move the structure has applied to the City and paid a fifty dollar ($50.00) fee to have the structure and the proposed pro-posed site of the structure struc-ture inspected by the City before it is moved to determine all of the changes or improvements necessary to bring the structure and site into compliance with the City's current applicable codes (zoning, building, electrical, plumbing, etc.) relating to that structure and site. : b. The requirements for the building shall be identical to the requirements for any newly constructed building. The site plan which is submitted must be drawn to scale and show all relevant dimensions. dimen-sions. In addition, the site plan shall indicate all adjacent lots as well as all structures and improvements im-provements on those lots. c. The appropriate fees are paid to the City and appropriate permits are obtained. d. All necessary dedications dedi-cations of property have been made to the City as required by the City ordinances or-dinances or resolutions. e. The applicant has posted a cash bond with the City in an amount determined by the City to be the cost of making all of the changes and improvements im-provements necessary to bring the structure and sites (both the vacated site and the proposed site) into compliance with all of the applicable City codes. This bond is posted to ensure that all necessary changes and improvements are made and approved by the City within one (1) year of the date the structure is moved into the City. 2. Old site is to be restored. If the site to be vacated is within the City, the applicant shall clean up the vacated site, remove all old brick, lumber, debris and trash, fill in or otherwise dispose dis-pose of any basements andor foundations, and restore the site to a safe and sightly condition. 3. If, after a period of one year, all of the changes and improvements improve-ments necessary to bring the structure into compliance com-pliance with the City's codes have not been completed, com-pleted, the bond specified in subparagraph 1(e) above shall automatically forfeit to the City. The City shall then use the bond monies to contract with independent contractors to make all of the necessary changes or improvements. Any monies remaining after the completion of the improvements shall be returned to the applicant who posted the bond. 4. No person shall occupy or use nor shall any person permit any other person to occupy or use any house, building or other structure which has been brought into the City or which has been moved from one lot in the City to another unless and until the conditions of this section have been complied with and a certificate cer-tificate of occupancy has been obtained from the building inspector. 5. No building shall be temporarily located on any site within the City for more than sixty (60) days. "Temporarily located" shall mean located on any site which is not intended to be the permanent location for the building and which site has not been approved ap-proved pursuant to the provisions of this section. Permission to temporarily tempor-arily locate a building on any site for more than sixty (60) days may be granted only by the City Council upon good cause shown. 6. Any person violating vio-lating the terms of this section shall be guilty of a misdemeanor. C. LEGAL NOTICE ORDINANCE NO. 417 AN ORDINANCE CREATING THE OREM BEAUTIFICATION COMMISSION, COM-MISSION, PROVIDING GUIDELINES FOR ITS MEMBERSHIP AND OPERATION, AND REPEALING CHAPTER 26 OF THE OREM CITY CODE. WHEREAS the City Council has previously determined that the functions of the Shade Tree Commission should be expanded to include activities to develop pride in the City of Orem; and WHEREAS the City Council desires to define the membership, duties and basic procedures of the new organization to be known as the Orem Beautification Commission. Com-mission. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OREM, UTAH, as follows: 1. Section 2-165 through 2-173 are hereby enacted as set forth in "Exhibit A" attached hereto. 2. Chapter 26 of the Orem City Code is hereby repealed. 3. All ordinances, resolutions and policies in conflict herewith are hereby repealed. 4. This ordinance shall take effect immediately im-mediately upon passage. There is hereby established the Orem Beautification Commission, Com-mission, which shall be an independent, nonprofit, nonpolitical organization devoted exclusively to the development of pride in the City of Orem and to the promotion and protection of shade and ornamental trees in the streets, parks and public grounds of the City. ' Sec. 2-166. Membership Mem-bership and organization The Orem Beautification Commission Com-mission shall consist of nine (9) members. Sec. 2-167. Appointment; Ap-pointment; tenure in office. . All members of the Orem Beautification Commission shall be appointed by the Mayor with the consent of the City Council. The term of office for each member shall be four (4) years, except that five (5) of the initial members shall receive an appointment to serve for two (2) years only. Thereafter, all members shall be appointed ap-pointed to serve a regular term of four (4) years. The chairman shall be elected by the Orem Beautification Commission Com-mission from its membership mem-bership by majority vote and shall serve for a period of one year and shall only vote in the case of a tie. The chairman, upon recommendation of the members, may recommend prospective members for appointment ap-pointment to the Orem Beautification Commission Com-mission to the mayor, and members of the Beautification Commission Com-mission may be released without cause by the City Council. Sec. 2-168 . Duties The Orem Beautification Commission Com-mission shall be responsible for study, review, and recommendation recom-mendation on area of community pride and beautification to the City Council. Sec. 2-174. Duties of commission. It shall also be the duty of the Orem Beautification Commission Com-mission to make plans for the planting, care of, removal and protection of shade trees on all public streets and other city-owned city-owned property in the city, and to foster shade tree culture within the city. Such plans and recommendations shall be prepared in the form of regulations to be certified to the City Council. The City Council shall hold a public hearing after fifteen (15) days' notice by publication one time in a newspaper, and may then adopt such regulations, with such changes as the City Council thinks desirable, as the shade tree regulations of the city. Sec. 2-169. Meetings. The Orem Beautification Commission Com-mission shall meet at least once each month or as the chairman directs after giving due notice to the members to the time and place of such meeting. Each member of the Commission is entitled to one vote. The Commission may organize and conduct its business. Sec. 2-170. Recommendations. Recom-mendations. The chairman of the Orem Beautification Commission shall from time to time bring forth such recommendations which have the approval of the Commission to the City Council for their ..acceptance or whatever other action they deem appropriate after due consideration. Article IX. Beautification Commission Sec. 2-171. Compensation. Com-pensation. The membership of the Orem Beautification Commission shall serve without monetary compensation except for extraordinary travel expenses. Sec. 2-172. Appointed employee assistance. Appointed employees of the city, to include the City Planner and Public Workd Director or their designees, .shall be designated to 'attend the meetings of the Orem Beautification Commission Com-mission as deemed appropriate ap-propriate and to provide such assistance as necessary to further the carrying out of the duties of the Commission. The city shall also provide clerical assistance whenever necessary. Sec. 2-173. Commission Com-mission may receive gifts. The Orem Beautification Commission Com-mission shall, on behalf of and with the consent of the City Council, have the authority to receive gifts or bequests from any person or from any source for the development develop-ment or improvement of civic pride, or for tree planting or maintenenace on any street or other public property. Said gifts or bequests shall be received by the city treasurer and put into a special fund for the purposes above set out. Published in the Orem-Geneva Times on Jan. 15, 1981. LEGAL NOTICE ORDINANCE NO. 418 AN ORDINANCE AMENDING AM-ENDING CHAPTER 17 OF THE OREM CITY CODE AND CREATING A DEPARTMENT OF RECREATION AND OREM RECREATION ADVISORY COMMISSION COMMIS-SION AND DEFINING THE RESPECTIVE DUTIES, POWER AND RULES OF THOSE BODIES. WHEREAS the City of Orem has recently assumed recreation responbilities from the Sharon Cooperative Educational Edu-cational Recreational Association; and WHEREAS the City has completed and now operates the Orem Recreational Rec-reational Center; and WHEREAS the City has hired additional personnel per-sonnel to supervise the Recreation Center as well as other recreational activities; and WHEREAS the City desires to define and implement an effective and coordinated recreation recrea-tion program for the benefit of the residents of Orem. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OREM, UTAH, as follows: 1. Chapter 17 of the Orem City Code is amended to read as set forth in the attached document marked "Exhibit A." 2. All ordinances, resolutions and policies in conflict herewith are hereby repealed. 3. The Department of Recreation is hereby created, the purpose of which shall be to organize and supervise a comprehensive com-prehensive recreation and leisure services program pro-gram that will employ the leisure time of the people in a constructive and wholesome manner, to the end that the health, happiness, recreational opportunities and wholesome whole-some enjoyment of life by the residents of the City of Orem may be further encouraged. It shall be the duty of the Department Depart-ment to supervise all rec-reational rec-reational activities authorized by law and to equip, operate and maintain main-tain all recreation facilities faci-lities within the City. Sec. 17-2. Donations. The Department of Recreation may take charge of and use any grounds, buildings, or other facilities which may be offered, either temporarily or permanently per-manently by any individual indi-vidual or corporation for playgrounds and recreational rec-reational purposes; and may receive donations, legacies, bequests or devises for the establishment, establish-ment, improvement or maintenance of recreational recrea-tional facilities and activities. ac-tivities. All moneys so received shall, unless otherwise provided by the terms of the gift or devise, be deposited in the treasury of the City to the credit of the recreation recrea-tion fund, and may be withdrawn only in the manner provided for the ' payment of money appropriated appro-priated for the acquisition, acquisi-tion, improvement, operation oper-ation and maintenance of playgrounds and other facilities and activities. - Sec. 17-3. Recreation Advisory Commission Established. The Orem Recreation Advisory Commission is hereby established. Sec. 17-4. Member ship of Commission; Voting Rights. The Orem Recreation Advisory Commission shall consist of nine (9) members, one to be designated from among the members of the City Council; the other eight (8) members of the Commission Com-mission shall be appointed by the Mayor with the consent of the City Council from among the qualified electors of the City. All nine members mem-bers shall have the right to vote on any matter of business coming before the Commission. Sec. 17-5. Terms of Office; Vacancies; Removal; Political Affiliation; Affi-liation; Compensation. The terms of office on the Recreation Commission Commis-sion for the designated City Councilman shall be determined by the Mayor, but shall not exceed ex-ceed the tenure of his office. The terms of office of-fice for each appointive member shall be four (4) years; provided, the that the term of two members will expire annually thereafter. Vacancies occurring oc-curring otherwise than by expiration of terms shall be filled by appointment appoint-ment by the Mayor with the consent of the City Council and shall be for the unexpired term of the vacated membership. Any member of the Commission Com-mission may be removed without cause by a majority vote of the City Council. Members shall be selected without respect to political affiliations affi-liations and shall serve without compensation. Sec. 17-6. Organization; Organiza-tion; Meetings, Quorum. The Commission shall annually organize by electing a chairman and vice-chairman from its membership. Meetings shall be held regularly at least once a month, at a time to be fixed by the Commission. It shall establish es-tablish its own rules of procedure and method of calling special meetings. The Director of Recreation, or his designee, desig-nee, shall attend all meetings of the Commission Commis-sion and shall act as secretary sec-retary to the Commission. Commis-sion. A majority of the members shall constitute a quorum. Sec. 17-7. Duties of Recreation Advisory Commission. The duties of the Recreation Advisory Commission shall be as follows: (1) To act in an advisory ad-visory capacity to the City Council in all policy matters pertaining to recreation and cooperate with the Alpine School District and other governmental agencies and civic groups in the advancement of sound recreation planning and programming. (2) To consider such matters as are referred to it by the City Council, and to make recommendations recommen-dations to the City Council as it may be deemed advisable by the Commission. (3) To advise and make recommendations to the proper authorities in matters pertaining to the development of recreation rec-reation programs. (4) To assist in promoting pro-moting public recreation programs and to stimulate stimu-late public interest therein. there-in. (5) To broaden citizen input by serving as a liaison for individuals and organizations who have an interest in recreation rec-reation programs. (6) To prepare and review annually and revise, as may be necessary, neces-sary, a long range plan for recreation. Sec. 17-8. Conduct in parks generally. It shall be unlawful for any person to use threatening, abusive, insulting in-sulting or indecent language lan-guage in the public parks of the city or to create any nuisance or offense, or to scratch, cut, injure or deface any of the buildings, fences, structures, struc-tures, trees or shrubbery, or foul any of the fountains, foun-tains, or any other improvement im-provement or to cut or injure flowers or flowerbeds flower-beds within the parks or for the owner of any dog to allow the same to run at large within the parks. Sec. 17-9. Permission required for gatherings in parks. It shall be unlawful for any person to hold a meeting, gathering, musical, theatrical or entertainment en-tertainment in the parks of the city without first having received permission permis-sion from the Department Depart-ment of Recreation. Sec. 17-10. Areas in parks where traffic prohibited. pro-hibited. It shall be unlawful to drive any vehicle or animal or to allow any vehicle or animal to proceed pro-ceed on or over any garden, gar-den, lawn, sidewalk, beach, wall or any other portion of any public park unless the same is designated desig-nated for vehicular or animal traffic. It shall be presumed for the purposes pur-poses of this chapter that any area in use at the time as a picnic or recreational rec-reational area or otherwise other-wise in use by pedestrian traffic is prohibited for use by vehicular or animal traffic. Sec. 17-11. Speed in parks. It shall be unlawful to drive any vehicle or ride any animal within the area of a city park at a speed greater than fifteen (15) miles per hour unless otherwise posted by the City. Sec. 17-12. Parking. It shall be unlawful to park any vehicle upon city parks property in such a way as to block the roads provided, to park other than in the public parking area. Sec. 17-13. Littering in parks. It shall be unlawful to cause or allow any foreign materials, papers, bottles, rags or discarded articles of any substantial kind or nature to be left in parks other than in receptacles, designed and placed for that purpose. Sec. 17-14. Violations punished as misdemeanors. mis-demeanors. Violation of the provisions pro-visions of this Chapter shall be punished as misdemeanor, mis-demeanor, but in no event shall the punishment punish-ment be greater than that imposed by the statutes of the State of Utah.
