Show Legal Notice April 7, 1977 Orem-Ueneva Times tr WW k. - A '"" NOTICE OF INTENTION PUBLIC NOTICE IS HEREBY GIVEN that on the 22nd day of March, 1977. the Mayor and City Council of Orem City! Utah County, Utah adopted a resolution declaring its intention to create a special improvement district to be known as Orem City, Utah Special Improvement District No. U. It is the intention of The City Council to make improvements within said Special Improvement District and to levy special taxes as provided in Chapter 16, Title 10, Utah Code Annotated, (1953), as amended, on the real estate lying within said District for the benefit of which such taxes are to be expended in the making of such improvements. DESCRIPTION OF DISTRICT The proposed Special Improvement Improve-ment District shall include both sides of 300 East Street from 400 South Street to 375 South; the west side of 400 East Street from 663 North to 800 North Street; the east side of 600 East Street from 554 North to 600 North Street; the south side of 600 North Street from 600 East Street to 650 East Street; and the west side of 650 East Street from 600 North Street to 571 North. INTENDED IMPROVEMENTS The improvements to be constructed con-structed within said Special Improvement Im-provement District No. U in general include the removal of nonconforming non-conforming improvements; the excavation ex-cavation for the construction of combination curb, gutter and sidewalk; the construction of drive approaches and appurtenant drainage facilities; the construction of irrigation water pipelines with headgates and other appurtenant structures; strip paving; and the purchase, condemnation or other acquisition of any property necessary to make such improvements; im-provements; and all other miscellaneous work necessary to complete the work in a proper workmanlike manner. Without limiting the above general description of improvements improve-ments it is intended that the improvements im-provements be constructed in the designated areas as follows: Combination curb, gutter and sidewalk Excavation for and construction con-struction of combination curb, gutter gut-ter and sidewalk four inches thick and combination curb, gutter and drive approach seven inches thick together with appurtenant drainage facilities: Both sides of 300 East Street from 400 South Street to the south boundary line of Sherwood Meadows Subdivision Plat A; the east side of 600 East Street from the south property line of 554 North to 600 North Street; South side of 600 North Street from 600 East Street to 650 East Street; west side of 650 East Street from 600 North Street to the north property line of 571 North; the west side of 400 East Street from the south property line of 663 North to the north property line of 685 North and from the south property line of 755 North to 800 North Street. Strip paving - Excavation for and placement of base gravel and two inch thick asphalt pavement from existing asphalt pavement to the new gutter line, the width varying as needed: The east side of 600 East Street from south property proper-ty line of 554 North to 600 North Street; the south side of 600 North Street from 600 East Street to 650 East Street; the west side of 650 East Street from 600 North Street to north property line of 571 North; and the west side of 400 East Street from south property line of 663 North to north property line of 685 North and from south property line of 755 North to 800 North Street. ESTIMATED COSTS OF IMPROVEMENTS The total cost of all improvements improve-ments in said Special Improvement District as estimated by the City Engineer is $40,294.85, of which the City will pay $ 1 9,465.59 leaving a remainder of approximately $20,829.26 which shall be paid by a special tax to be levied against the property abutting upon the streets to be improved or upon property which may be affected or specifically benefited by such improvements. im-provements. The property owners' portion of the total estimated cost of the improvements will be financed finan-ced during the construction period by the use of interim warrants. The interest on such warrants will be assessed to the property owners. The estimated cost per lineal foot of frontage to be assessed against the properties within said District is as follows: Improvements-Combination curb, gutter and sidewalk-Estimated Cost-$8.50 per front foot. The City will pay for all property proper-ty necessary for right-of-way and all irrigation pipeline. ASSESSMENTS AND LEVY OF TAXES It is the intention of the City-Council City-Council of Orem City, Utah to levy assessments as provided by the laws of Utah on all parcels and lots of real property within the District. The purpose of the assessment and levy is to pay those costs of the subject improvements which the City will not assume and pay. The method of assessment shall be apportioned ap-portioned according to lineal front footage of lots and parcels of property within the District. The assessments may be paid by property owners in ten (10) annual an-nual installments with interest on the unpaid balance at a rate or rates not to exceed nine percent (9) per annum as fixed by the City Council, or the whole or any part of the assessment may be paid without interest within fifteen (15) days after the ordinance levying the assessment becomes effective. The assessments shall be levied according ac-cording to the benefits to be derived by each property within the District. Other payment provisions and enforcement remedies shall be in accordance with Chapter 16 of Title 10 of Utah Code Annotated, (1953), as amended. amen-ded. A map of the proposed District, copies of plans, profiles and specifications of the proposed improvements and other related information in-formation are on file in the office of the City Recorder who will make such information available to all interested in-terested persons. TIME FOR FILING PROTESTS Any person who is the owner of record of property to be assessed in the Special Improvement District described in this Notice of Intention Inten-tion shall have the right to file in writing a protest against the creation of Special Improvement District No. U or to make any other objections relating thereto. Protests shall describe or otherwise identify the property owned of record by the person or persons making the protest. Protests shall be filed with the City Recorder of Orem City, Utah, on or before 5:00 p.m. on the 3rd day of May, 1977. Thereafter at 8:00 p.m. on the 3rd day of May, 1977, the City Council will meet in public meeting at the City Chambers to consider all protests so filed and hear all objections objec-tions relating to the proposed Special Improvement District No. U.
