Show Legal Notice Legal Notice Orem-Geneva Times April 10. 1975 Legal Notice ALPINE DISTRICT A RESOLUTION confirming the sale and authorizing the issuance is-suance of $2,360,000 School Building Bonds, Series March 15, 1975, of the Board of Education of Alpine School District, Utah County, Utah, fixing the interest rates to be borne thereby, providing pro-viding for the levy of taxes to pay principal of and interest on said bonds, providing for the use of the proceeds thereof, making certain findings and covenants in connection therewith, and ratifying ratify-ing actions heretofore taken. WHEREAS at a special bond election duly and lawfully called and held in Alpine School District, Dis-trict, Utah County, Utah, on October Oc-tober 18, 1973, the issuance of $4,000,000 bonds was authorized for the purpose of raising money for purchasing school sites, for building or purchasing one or more schoolhouses and supplying supply-ing the same with furniture and necessary apparatus, and for improving im-proving school property under the charge of the Board of Education, Ed-ucation, the result of which election elec-tion was declared by the Board of Education, sitting as a Board of Canbassers, on October 24. 1973; and ' WHEREAS of the bonds voted at said October 18, 1973, election elec-tion $1,640,000 bond have heretofore here-tofore been issued and delivered, and it has been determined to authorize the issuance and sale of the remaining$2,360,000 bonds at this time; and WHEREAS a notice inviting sealed bids for the purchase of said $2,360,000 bonds has been advertised by publication of a Notice of Bond Sale in the Daily Bond Buyer, a newspaper published pub-lished in New York, NewYork, on March 6, 1975, and broughi to the attention of potential purchasers pur-chasers and the bids received pursuant to such notice have been tabulated, and it has been found that the bid of United California Bank of Los Angeles, California, and associates, is the highest and best bid received for the purchase of said bonds, resulting re-sulting in the sale of such bonds at the lowest obtainable interest rate, said bid reading in full as follows: UNITED CALIFORNIA BANK Bond Department . 707 Wilshire Boulevard . That the bid of United California Bank of Los Angeles, California, and associates, for the purchase of $2, 360,000 School Building Bonds, Series of March 15, 1975, of the Board of Education of Alpine School District, pursuant pursu-ant to the bid which is set out in full in the preamble hereto, be and the same is hereby accepted, it being hereby found, determined and declared after public advertisement for bids for the purchase of said bonds, that said bonds bear interest at the lowest obtainable interest rate, and that under authority au-thority of Chapter 14 of Title 11, Utah Code Annotated, 1953, otherwise known as the Utah Municipal Bond Act, such bonds shall be issued by said board for the purpose of raising money for purchasing school sites, for building or purchasing pur-chasing one or more schoolhouses, and supplying the same with furniture and necessary apparatus, and for improving school property under the charge of the Board of Education. Educa-tion. Section 2. That said bonds shall be known as 'School Building Build-ing Bonds, Series March 15, 1975 shall be in the denomination denomina-tion of $5,000 each, numbered 1 to 472, inclusive, dated March. 15, 1975, shall bear interest from their date until paid, said interest being payable March 15, 1976, and semiannually semi-annually thereafter on March 15 and September 15 of each year, and shall be numbered, bear interest and fall due serially in numerical onrer on" March 15 ol each of the years as follows: BOND NUMBERS 1 to 72 73 to 272 273 to 472 AMOUNT $ 360,000 1,000,000 1,000,000 Said bonds shall be callable for redemption in inverse numerical order at the option of the Board of Education on March 15, 1985, and on any interest payment date thereafter at the price of par and accrued interest to the date fixed for redemption plus aprem-ium, aprem-ium, expressed as a percentage of the principal amount of each bond so called for redemption, of two and one half per cent (2-12) for each bond so called for redemption prior to maturity. At least thirty (30) days notice of the call for redemption shall be given by publication of an appropriate notice one time in a financial newspaper or journal published in the City of NewYork, New York, and by registered mail sent to the paying agent banks and to Burrows, Smith and Company in Salt Lake City, Utah. Section 3. That both principal of and interest on said bonds shall be payable in lawful money of the United States of America at Walker Bank & Trust Company, in Salt Lake City, Utah, or, at the option of the holder, at The Northern Trust Company in Chicago, Illinois. Said bonds shall be signed by the President and attested by the Clerk of the Board of Education (the signature signa-ture of said President being by facsimile) and shall have the facsimile fac-simile of the corporate seal of said board printed thereon, and shall have coupons for interest attached, which coupons shall be signed with the printed facsimile signatures of the President and Clerk of the Board of Education, and the preparation of said printed facsimiles of said President Pres-ident on the bonds and of said President and Clerk upon said coupons is hereby adopted by the Board as the authorized and au thentic signing of said bonds and coupons by said officials. Section 4. Tnis' Dond is one of an issue of $2,360,000 bonds of like date and tenor, except as to maturity and interest rate, issued for the purpose of raising money for purchasing pur-chasing school sites, for building or purchasing one or more schoolhouses any supplying the same with furniture and necessary nec-essary apparatus, and for improving im-proving school property under the charge of the Board of Education, Edu-cation, and is issued under the pursuant to the provisions of the Constitution and laws of theState of Utah, including particularly the Utah Municipal Bond Act, Chapter 14 of Title 11, Utah Code Annotated, Anno-tated, 1953, after having been authorized au-thorized at an election held on October 18, 1973, in said district dis-trict by vote of the qualified electors elec-tors of said district. The Board of Education of Alpine Al-pine School District covenants and is by law required to levy annually a sufficient tax to pay the interest on this bond as it falls due and also to constitute a sinking fund for the payment of the principal thereof as the same falls due. It is hereby certified, recited and declared that all acts, conditions con-ditions and things essential to the validity of this bond exist, have happened and have been done, and that every requirement of law affecting the issue hereof has been duly complied with, and that this bond is within every debt and other limit prescribed the Constitution and laws of said state, and that the full faith and credit of said Board of Education Ed-ucation of Alpine School District Dis-trict are hereby irrevocably pledged to the punctual payment of the principal of and interest on this bond, according to its terms. That all proceedings, proceed-ings, resolutions and actions of this Board of Education and its officers taken in connection with the sale and issuance of the aforesaid $2,360,000 School Building Bonds, Series March 15, 1975, are hereby ratified, confirmed and approved, including in-cluding the publication of the notice no-tice of sale for said bonds as set out in the preamble hereof. Section 11. That this resolution resolu-tion shall be published one time in the Orem-Geneva Times, a newspaper published and of general circulation in Alpine School District, and for a period per-iod of thirty (30) days after such publication any person in interest shall have the right to contest the legality of this resolution res-olution or of the bonds hereby authorized or any provisions made for the security and payment pay-ment of such bonds. After such time no one shall have any cause of action to contest the regularity, regu-larity, formality or legality of this resolution or the bonds herein authorized for any cause whatever. Section 12. That all resolutions resolu-tions or parts thereof in conflict con-flict herewith are, to the extent of such conflict, hereby repealed re-pealed and that this resolution shall be in full force and effect immediately upon its adoption. Brigham Young introduces himself as a student from Brigham Young University, Un-iversity, people usually say, "Ah, come on you're putting me on.
