Lot, Comef---A lot abutting on two intersecting or intercepting ttreeU where the interior angle of intersection or interception does not exceed 135. 26. Lot, Interior A lot other than a corner lot. 27. Lot Line, Front The front boundary line of a lot bordering on the street. In the case of a corner lot, the side bordering on the street which has the smaller dimension shall be the front lot line. 28. Lot Line, Rear A lot line which is opposite and most distant from the front lot line. In the case of an irregular, triangular, or gore-shape- d lot, the rear lot line shall be a line within the lot, parallel to and at the maximum distance from the front lot line, having a length of at least ten (10) feet. 29. Lot Line, Side Any lot boundary line not a front lot line or a rear lot line. 30. Mining The excavation, re-moval, dumping or transportation of mineral substances including but not limited to such mineral sub-stances as sand, gravel, earth, rock, cloy or petroleum and sulphur. 31. Nonconforming Building or StructureA building or structure or portion thereof, lawfully existing at the time this ordinance became effective, and which does not con-form with the use regulations of the zone in which it is located. 32. Nonconforming UseA use which lawfully occupied a building or land at the time this ordinance 3-- R-- l RESIDENTIAL 20NS Objectives The R- -l Residential Zone has been established as district in which the primary use of the land is for residential purposes. In addition to those general pur-pon-set forth in Article 1. of this ordinance the R-- l Residential Zone has been established for the further specific purposes of: 1. encouraging the development and continued use of the land with-in the zone for residential purposes. 2. promoting a more wholesome environment for family living and the rearing of children. 3. encouraging more serviceable and attractive residential areas. 4. prohibiting commercial and industrial use of the land within the zone, and prohibiting any other use which would interfere with or mili-tate against the continued use and development of the land within the zone for residential purposes. In order to accomplish the ob-jectives and purposes of this ordin-ance the following regulations shall apply in the R-- l Residential Zonet Use Requirements The following usee shall be per-mitted in the R- -l Residential Zone: I. Dwellings, including one-famil-two- famil- y, three-famil- and four-famil- y dwellings, apartment houses end other multiple dwellings, including boarding houses, lodging houses and dormitories, but not hotels, motels or other uses for the accommodation of transient guests. 3-- C-- l COMMERCIAL ZONE Objectives The C-- 1 Commercial Zone has been established as a district in which the primary use of the land is for commercial and civic pur-poses. , In addition to those general pur-poses set forth in Article I of this ordinance the C-- l Commercial Zone has been established for the further specific purposes of: 1. Encouraging the development and continued use of the land for commercial purposes. 2. Promoting the development of serviceable and convenient retail and service facilities. 3. Providing the most appropri-ate area for the development of commercial uses within the city and of preventing the scattering of commercial uses into residential areas. 4. Prohibiting industrial uses within the zone and discouraging any other use which thwarts or militates against the continued use and development of the- land for its primary purpose. In order to accomplish the ob-jectives and purposes of this ordin-ance the following regulations shall apply in the C-- l Commercial Zone: Use Requirements 1. Retail sales establishments. 2. Appliance service establish-ments. 3. Auto body and fender shops and auto painting, but not includ- - Zoning Ordinance bris on or about premises produces degeneration and instability in pro-perty values, accentuates obsoles-cence of buildings, lessens the wholesomeness and security of home life, deprives the city of tax revenues and destroys the proper balance between the taxable Value of real property and the cost ' of providing necessary municipal ser-vices and, in general, brings about a deterioration in public health, safety, comfort, morals and welfare of the citizens. Effect of Finding In view of this finding, no deter-iorated or dilapidated building shall be permitted to remain on any lot: nor shall any excessive amount of trash, rubbish, or debris be allowed . to remain on any lot, which pro-duces one or more of the harmful effects mentioned in paragraph of this ordinance. 4-- Land Previously Subdivided The requirements of this ordin-ance as to area and width shall not be construed to prevent the us for a one-fami- ly dwelling of any legal lot or parcel of land in any district in which dwellings are permitted in the event that such lot or parcel of land was of record at the time this ordinance became effective. 4-- Uses Uses which are not expressly permitted within a zone are ex-pressly prohibited therein. 4-- 7. Parking and Loading Space The intent of this paragraph is to encourage the parking of vehicles off the public streets so as to im-prove safety, reduce congestion, and facilitate street maintenance and traffic circulation. Offstreet Parking Required There shall be provided at the time of the erection of any build-ing, or at the time any main build-ing is enlarged or increased in ca-pacity, minimum off-stre- parking space with adequate provisions for ingress and egress from the i street to each parking space by standard sized automobiles as hereinafter provided. A minimum area of two hundred (200) square feet, plus adequate provision for ingress and egress from the street to each park-ing space shall be considered as a space for one automobile. Parking Space for Dwellings bn all zones, except those in which dwellings are not permitted, .there shall be provided space for the parking of one yautomobile for each dwelling unit in a new dwell- - 11. Railroads, railroad tracks, switches and facilities for the ing of general freight. Railroad tracks, switches and facilities for hauling of ores and other mineral substances provided all tracks and switches used for hauling ores and other mineral substances shall be located at least two hundred fifty (250) feet (horizontal distance) from any reeidential or commercial zone boundary line, 1 2. Plumbing shops. 19. Planing mills. 20. Sign boards,, billboards. 2 I . Ore processing, except smel-ting- 22. Tinesmithing. 23. Welding shops. 24. Wholesale establishments. 25. Warehousing. 26. Other uses ruled by the Plan-ning Commission to be similar to the above permitted uses, except that junk yards, salvage yards, auto wrecking yards, animal plants, smelters, ore stamping, and similar uses which emit noise, odor, smoke, vibration, glare, heat, dust in quantities sufficient to depreciate property values, or substantially interfere with the enjoyment of property rights within the zone or within any residential or commer-cial zone shall be excluded from this zone. Density Requirements There shall be no area, height, or size of building requirements in the Industrial Zone. Special Provisions 1. Adequate sanitary facilities shall be provided as required by the Health Department. 2. All storage of equipment, ma-terials or merchandise, (except ve-hicles in running .order) shall be conducted within a building or en-closed within sight-obscurin- g masonry wall or metal fence at least six (6) feet in height, or shall be so located that the enclosed ma-terial cannot be seen from any street im any residential or com-mercial zone. ORDINANCE NO. 75 An ordinance of the City ol Bingham Canyon, Utah, dividing the city into xones; regulating and restricting within each of the xonei the height, number of stories, and size of buildings and structures, the percentage of lot that may be occu-pied, the size of yards, courts, and other open spaces, the density of population, and the location and use of buildings; prescribing the violation thereof, pro-viding methods of administration and enforcement, creating a Board of Adjustment and defining its du-ties and powers, and declaring an emergency. BE IT ORDAINED BY THE CITY COUNCIL OF BINGHAM CAN-YON, UTAH. ARTICLE I. TITLE, PURPOSE Title This ordinance shall be known as. and shall be entitled, THE ZONING ORDINANCE OF BING-HAM CANYON. UTAH, and may be so cited and pleaded. 2. Purpose The purposes of this ordinance shall be to promote the health, safety, morals and general welfare of Bingham Canyon, Utah, and 1. To encourage and facilitate the orderly growth and development of the city. 2. To promote sanitation and the health of the inhabitants. 3. To promote safety from fires, floods, traffic hazards, panic and other dangers. 4. To lessen congestion in the streets, to provide adequate light and ir. rrevent the overcrowding and located upon the sams lot oc- - cupied by a main use. 2. Apartment House A building I arranged, intended, or designed to ' be occupied by more than four (4) families living independently of ' each other and having separate cooking facilities. 3. Boarding House A building containing not more than one kitch- -. en, where for compensation meals . are provided for three (3) or more persons pursuant to previous ar- - rangements on at least a weekly , basis in contradistinction to a hotel For the of this , or a cafe. purpose ordinance, where the number of boarders are two persons or less, ' such boarders shall be considered as a part of a family. (See defin-ition of Family and Lodging House.) 4. Building Any structure hav-ing a roof supported by columns or walls for the housing or enclosure of persons, animals, or chattels. 5. Building, Accessory A de-tached subordinate building clearly incidental to and located upon the same lot occupied by a main build-ing including but not limited to a private garage, pergolas, or arbor. 6. Building, Height of The ver-tical distance from the grade to the square of the building. 7. Building, Main One or more of the principal buildings upon a lot. 8. Building, Public A building owned and operated or owned and intended to be operated by a public agency of the United States of Am-erica, of the State of Utah, or any of its subdivisions. 9. Carport A structure not completely enclosed by walls for the shelter of automobiles. became effective, and which does not conform with the use regula-tions of the zone in which it is located. 33. Parking Lots An open area other than a street used for the parking of more than four (4) auto-mobiles and available for public or private use, whether free, for com-pensation, or on accommodation for clients or customers. 34. Parking Space A space of at least two hundred (200) square feet within a building lot or park-ing lot for the parking or storage of one automobile having adequate provision for ingress and egress from a street by a standard sized automobile. 35. Square of Building The top (weighted average) of the exterior walls of a building. 36. Street A thoroughfare which has been dedicated to the public or which has been made public by right of use and which affords the principal means of ac-cess to abutting property. 37. Structure Anything con-structed or erected which is either located on the ground or attached to something having a location on the ground. 38. Sight Obscuring Fence or Wall The term as used in this ordinance shall mean a solid fence or wall of not less than six (6) feet in height nor more than eight (8) feet in height, 39. Trailer CampAny area or tract of land used to accommodate two (2) or more automobile trail-ers or camping parties. 40. Width of Lot, Frontage The distance between the side lot lines at the distance back from the front lot line required for the depth of the front yard. 41. Yard A space on a lot other than a court unoccupied and un-obstructed from . the ground up-wards by buildings except as other-wise provided herein. 42. Yard, Front A space on the same lot with a building between the front line of the building and the front lot line and extending across the full width of the lot. The depth of the front yard is the mini-mum distance between the front 2. Fences, walls, hedges. 3. Other uses deemed by the Planning Commission to be similal to or cognate with the above listed uses and which are in harmony with the objectives of this ordin-ance. Density Requirements 1. Area Requirements An area of land not less than one ( I ) square foot shall be provided for each one ( I ) square foot of floor space con-tained within all buildings located on the lot. 2. Height Requirements The maximum height of any building used for living purposes shall be twenty-fiv- e (25) feet. 3. Size of Building Requirement! There shall be rno requirement! for the size of buildings in the R-- l Residential Zone except that all buildings which are located on a lot shall not cover more than 75 of the lot area. 1 Special Provisions 1. Space around buildings shall be kept free from refuse, debris, and waste material. All refuse, de-bris and waste- material shall be placed within approved containers nd stored in a place which is not discernible from the street except during specific periods of time as may be allowed by other ordinances. 2. In the event that a building is razed or replaced, any new budding must comply with the provisions of this ordinance. See also SuDDlementarv Re in g, or each dwelling unit added in the case of the enlargement of an existing dwelling. Parking Space for Buildings or Uses Other Than Dwellings For boarding houses, and lodging houses there shall be provided I space for each guest room contain-ed within the building, .'' Off-Stre- et Truck Loading Space 1 On the same premises with every building used for the storage and warehousing of goods or for the receipt and distribution of goods by automobile vehicles, there shall be provided and maintained on the lot, adequate space for standing, load-ing, and unloading services in order to avoid undue interference with public use of the streets or alleys. Such space, unless otherwise ade-quately provided for, shall include ten (10) foot by twenty-fiv- e foot loading space with a minimum fourteen (14) feet height in clear- - " ARTICLE V. ENFORCEMENT 5- - 1. Office of Building inspector Established There is hereby established in the city the office of Building In-spector which shall be under the jurisdiction of the Mayor. The Mayor, with the advice and consent of the City Council, shall fill the office of Building Inspector and shall appoint a Building Inspector and such other officers as may be necessary to administer and enforce the provisions of this ordinance. 5-- 2. Building Inspector To Enforca Ordinance The Building Inspector of Bing-ham Canyon is hereby designated and authorized as the officer charg-ed with the enforcement of this ordinance. 5-- Building Permits Required No building or structure shall be constructed, reconstructed, altered, or moved nor shall the use of land be changed except after the issu-ance of a permit for the same by the Building Inspector. Schools, public. 33. Service stations. 34. Secondhand stores. 35. Signs. 36. Theaters (indoor). 37. Upholstery shops. 38. Other use ruled by the Planning Commission to be similar to the above listed uses and in har-mony with the objectives and char-acteristics of this zone. Density Requirement . In addition to those general pur-poses set forth in Article I. of this ordinance, the 1 Industrial Zone has been established for the further specific purposes of: 1. encouraging the continued use and development of the land within the zone for industrial purposes. 2. promoting the economic base and the economic wellbeing of the inhabitants of the city. 3. preventing the scattering of industrial, uses into other zones. In order to accomplish the ob-jectives and purposes of this ordin-ance, the following regulation shall apply in the 1 Industrial Zone: Use Requirement The following uses shall be per- mitted in the 1 Industrial Zone: 1. Any use permitted in the C-- l Zone except dwellings. 2. Blacksmith shops. 3. Building material sale yard and storage buildings. 4. Carpenter and woodwork shops. 5. Coal yards. 6. Cold storage plants. 7. Die casting. 8. Sign shops, sign painting. 9. Electric power substations. 10. Express storage and delivery station. of land and avoid undue concentra-tion of population. 5. "To secure economy in munici-pal expenditure and to facilitate adequate provisions for transporta-tion, water, sewerage, schools, parks, and other public require-ments. 6. To stabilize and improve pro-perty values and prevent obsole-enc- e and degeneration of building. 7. To increase the security of home life and preserve and create a more favorable environment in which to rear children. 8. To promote the development of a more wholesome, serviceable, and attractive city. ' Division of City into Zones Regulations In order to accomplish the pur-poses of this ordinance, the city is hereby divided into several zones, and in each of the zones, the height and number of stories, the size of buildings and other structures, the percentage of a lot that may be occupied, the size of yards, courts, and other open spaces, the density of population, the location and use of buildings, structures, and land are hereby regulated and restricted as hereinafter set forth. Declaration It is hereby declared that the zones, the boundaries thereof, and the regulations and restrictions ap-plying within each of the zones were made in accordance with a com-prehensive plan of zoning and that due and careful consideration was given, among other things, to the suitability of the land for particu-lar uses, and to the character of the zone, with a view to conserving the value of buildings and encour-aging the most appropriate use of land throughout the city. 5. Intent It is the intent of the City Council of Bingham Canyon, Utah, that the regulations and restrictions as set forth in this ordinance shall be so interpreted and construed as to fur-ther the objectives and purposes of this ordinance. 6. Interpretation In interpreting and applying the provisions of this ordinance,' the requirements contained herein are declared to be the minimum re-quirement for the purposes set forth. Definition For the purpose of this ordinance certain words and terms are defin-ed as follows: Words used in the present tense include the future. Words in the singular number include the plural and the plural the singular. Words not included herein, but defined in the Building Code shall be constru-ed as defined herein. 1. M-- l MINING ZONE Objective The M-- l Mining Zone has been established a a district in which the primary use of the land is for mining purposes and use inciden-tal thereto. , . In addition to those general pur-poses set forth in Article I of this ordinance, the M-- l Mining Zone has been established for the further specific purpose of: It promoting the continued use of the kind within the zone for min-ing purpose. . 2. preventing the establishment of use within the- mining zone which would interfere with' the use of the land for mining purposes. 3. stabilizing the value of build-ings throughout the city. 4. preventing the encroachment of mining operation into other zone within the city. In order to accomplish the ob-jective and purposes of this ordin-ance, the following regulations shall apply in the M-- l Mining Zone: Use Requirement The following uses shall be per-mitted in the M- -l Mining Zone: 1. Excavation of earth material and ore. 2. Mining and milling of ore and buildings and structures pertaining thereto. ' 3. Railroads, railroad tracks, switches and facilities for the haul-ing of general freight.'- ' 4. Railroad tracks, switches and facilities for hauling of ores and other mineral substance provided all track and switches used for hauling ores and other mineral sub-stances shall be located at least two hundred fifty (250) feet (horizon-tal distance) from any residential or commercial zone boundary line. 5. Power plant and tranimissior lines. 6. Maintenance facilities and building. .. 7. Office building. , . 8. Storage of explosives. ' 9. Other uses ruled by the Plan-ning Commission to be in harmony with the purposes of this zone. Density Requirement There shall be no area, height, or size of building requirements in the M-- l Mining Zone. Special Provision Adequate sanitary facilities shall be provided as required by the Health Department. 3- - See also Supplementary Re-gulations to All Zone. ARTICLE IV. SUPPLEMENTARY REGULATIONS TO ZONES 4- - 1. Effect of Article The regulation set forth in this article qualify and supplement, at the case may be, the zone regula-tions appearing elsewhere in this ordinance. 4-- Yard Space for One Building "Only No required yard or other open space around an existing building, or which is hereafter provided any building, for the purpose of complying with the provisions of thi ordinance shall be consider-ed . as providing a yard or other open space for any other building, nor shall any yard or other requir-ed open space on an adjoining lot be considered a providing the yard or open space on the lot whereupon a building is to be erected or estab-lished. 4-- Sale or Lease of Required Space No space needed to meet the width, yard, area, coverage, park-ing, or other requirements of this ordinance for a lot or building be may sold or leased apart from uch lot or building unless other space so complying is provided. 4-- 4. Dwelling, Two-famil- y A building arranged or designed to be occupied by two families, the struc-ture having only two dwelling units. 13. Dwelling, Three-famil- y A building arranged or designed to be occupied by three families, the structure having only three dwell-ing units. 1 4. Dwelling, Four-famil- y A building arranged or designed to be occupied by four families, the structure having only four dwelling units. I 5. Dwelling, Multiple A build-ing arranged or designed to be oc-cupied by more than four families: apartment houses. I 6. Dwelling Unit One or more rooms in a dwelling designed for or occupied by one family for living or sleeping purposes and having one kitchen or set of cooking facili-ties. 1 7. Family An individual or two (2) or more persons related by blood, murriage, or adoption living together in a dwelling unit. For the purpose of thi ordinance, guests in excess of two (2) shall be con-sidered as boarders, and the build-ing in which they abide shall be considered as a boarding house. (See definition of Boarding and Lodging House.) 18. Garage, Public A building or portion thereof, other than a private garage, designed or used for servicing, repairing, equipping, hiring, selling, or storing motor-drive- n vehicles. 1 9. Grade The average of the finished ground level at the center of 11 walls of a building. In case of walls parallel to and wihin thirty-fiv- e (35) feet of a sidewalk, the aboveground level shall be measur-ed at the sidewalk. 20. Guest A person received for entertainment at a hotel, motel, boarding house, or rooming house upon customary terms. 2 I . Home Occupation An occu-pation carried on entirely within a dwelling by persons residing within the dwelling and where there is no visual indication from outside the building that the occupation is be-ing carried on therein. 22. Household Pets Animals 01 fowl ordinarily permitted in the house and kept for company or pleasure, including but not limited to dog, cats, canaries, and chin-chillas. 23. Lodging House A building where sleeping accommodation are provided to three or more person for compensation pursuant to pre-vious arrangement on at least a weekly basis in contradistinction to a hotel, tourist home, or motel. For the purpose of this ordinance, where the number of lodgers two persons or less, such lodgers shall be considered as part of a family. (See definition of Boarding House and Family.) 24. Lot A parcel of land occu-pied or to be occupied by a build-ing or group of buildings together with such yards, open spaces, lot width, and lot area a required by thi ordinance, having a frontage on the street or upon a right-of-w- ay which has been approved by the Board of Adjustment, ji lot line and the front line of the building. 43. Yard, Rear A space on the same lot with the building between the rear line of the building and the rear lot line and extending the full width of the lot, The depth of the rear yard is the minimum distance between the rear lot Line and the rear line of the building. 44. Yard, Side A space on the same lot with the building between the side line of tha building and the side lot line and extending from the front yard to the rear yard. The width of the side yard shall be the minimum distance between the side lot line and the side line of the building. ARTICLE II. ESTABLISHMENT OF ZONES 2-- The City of Bingham Canyon, Utah, is hereby divided into zones as follows: R-- l RESIDENTIAL ZONE R-- 2 RESIDENTIAL ZONE C-- l COMMERCIAL ZONE 1 INDUSTRIAL ZONE M- -l MINING ZONE 2-- Location of Zones The location and boundaries of each of the zones are shown on the ZONE MAP OF BINGHAM CAN-YON, UTAH, and aoid map is here-by declared to be an official record and a part of this ordinance, and said zone map and all notations, references, and other information shown thereon shall be a much a part of this ordinance as if the mat-ters and other information set forth by said map were fully described herein. 2-- Boundaries of Zones Where uncertainty exists with respect to the boundaries of various zones, the following rules shall apply: 1. Where the intended boundaries on the zone map are approximately street or alley lines, said street or alleys shall be construed to be the zone boundaries. 2. Where the indicated bound-aries are approximately lot lines, said lot lines shall be construed to be th-- ) zone boundaries, unless otherwise indicated. 3. Where land has not been sub-divided into lots, the zone boundary shall be determined by the use of the scale of measurement shown on the map. 4.. Where other uncertainty ex-ists, the Board of Adjustment shall interpret th-- map. ARTICLE HI. REGULATIONS WITHIN ZONES Within each of the zones, regu-lation and restriction are hereby established as follows: r, j gulations to Zones. 3-- R-- RESIDENTIAL ZONE Objective The R-- 2 Residential Zone has been established as a district in which the primary use of the land is for residential purposes. This zone is characterized by greater residential densities and more com-pact development than is character-istic of the R-- l Residential Zone. In addition to those general pur-poses set forth in Article I of thi ordinance the R-- 2 Residential Zone has been established for the fur-ther specific purposes of: 1. encouraging the development and continued use of the land with-in the zone for residential purposes. 2. promoting a more wholesome environment for family living and the rearing of children. 3. encouraging more serviceable and attractive residential areas. 4. prohibiting commercial and industrial use of the land within the zone, and prohibiting any other use which would interfere with or mili-tate against the continued use and development of the land within the zone for residential purposes. In order to accomplish the ob-jectives and purposes of thi or-dinance the following regulation shall apply in the R-- 2 Residential Zone. Use Requirement The same as permitted in the R-- l Residential Zone. Density Requirement 1. Area Requirements An area of land of not less than, one half (') square foot shall be provided and maintained for each one (I) square foot of floor space contain-ed within the buildings located on the lot. 2. Height Requirements The maximum height of any building used for living purposes shall be twenty-fiv- e (25) feet. 3. Size of Building Requirements There shall be no requirements for the size of buildings in the R-- 2 Residential Zone. Special Provisions 1. Space around buildings shall be kept free from refuse, debris and waste material. AH refuse, de-bris and waste 'material shall be placed within approved containers and stored in a place which i not discernible from the street except during specific periods of time as may be allowed by other ordinances. 2. In the event that a building is razed or replaced, any new build-ing must comply with the provis-ions of this ordinance. See also Supplementary Re-gulations to Zone.
