Show Page A8 Thursday, August ILcBtfall I LEGAL NOTICE ORDINANCE 124 AN ORDINANCE ADOPTING AND PROVIDING FOR THE PUBLICATION OF A-MENDMENTS A-MENDMENTS TO THE DEVELOPMENT CODE OF SUMMIT COUNTY, UTAH WHEREAS, the health, peace, safety, convenience, convenien-ce, order, prosperity and general welfare of the present and future inhabitants of Summit County, Utah, has been promoted by the adoption of a Development Code for the purpose of guiding development within the County, and WHEREAS, the Board of County Commissioners has deemed that certain amendments to the Development Code will further enhance the general welfare of the present and future inhabitants of Summit County, and WHEREAS, A PUBLIC HEARING HAS BEEN HELD FOR THE PURPOSE OF GIVING PUBLIC CONSIDERATION CON-SIDERATION TO THE ADOPTION OF SAID AMENDMENTS. NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF SUMMIT, SUM-MIT, STATE OF UTAH, ORDAIN AS FOLLOWS: Section 1. The following amendments to THE DEVELOPMENT CODE OF SUMMIT COUNTY Addition to Section 13.4 6)a)(x) "approval by the Snyderville Basin Sewer Improvement District" Add to Section 14.2 (9) "; and acknowledged by the Summit County Planning Plan-ning Commission by September Sep-tember 1, 1982, or for which written application has been received by September Sep-tember 1,1982." Amend Section 14.3 A to read Acknowledgement of Preexisting Time Share "; The Planning Commission Com-mission shall acknowledge pre-existing time share projects, in writing, by September 1, 1982, upon written application; ap-plication; or have received written application by September 1, 1982 requesting such acknowledgement. Written Writ-ten application shall be made to the County Planning Plan-ning Office. Any firm, corporation, person or persons violating any of the provisions of said Development Code, including in-cluding the adopted amendments thereto, shall be guilty of a Class C Misdemeanor and upon conviction thereof shall be punished by a fine not to exceed $299.00 or by imprisonment im-prisonment for any term not exceeding ninety (90) days or by both such fine and improvement. In addition, ad-dition, any such firm, corporation, cor-poration, or person shall be civilly liable to the County by way of damages or injunction for such violation. Section 4. This ordinance ordinan-ce shall take effect sixteen (16) days after its passage and publication in book form and after filing 3 copies of said Amendments Amend-ments in the office of the Summit County Clerk and Recorder. The Utah State Division of Wildlife Resources (DWR) has made application ap-plication for the above public lands under the provisions of the R&PP in order to add these parcels to the Wallsburg Game Range , which DWR manages, and to provide hunting, camping, bird watching, hiking, dog training and other recreational activities which are compatible with wildlife use to the public. Parcels 95 and 103 are presently under reclamation withdrawals which are scheduled to be reviewed shortly. Until the withdrawals are reviewed, the lands shall be available for lease to DWR under the R&PP Act and will be available for disposal to them if the withdrawal is removed. These lands are valuable for public purposes as contemplated by 43 CFR 2430.4(a) and may properly be classified for lease and disposal under the R&PP Act as stated in 43 CFR 2430.4(c). This classification is consistent con-sistent with the criteria of 43CFR2140.1(a-d). ' Classification of these lands under the provisions of the above-cited R&PP Act will segregate them from all appropriations, including the mining laws.
