Davey Crockett wouldn't recognize the place You had to know there were some changes in the wind when the Park City Chamber of CommerceCon vention and Visitors Bureau announced plans to hold its first quarterly membership social at the Alamo. The Alamo? Had the Sundowners Sun-downers Motorcycle Club joined the Chamber? No, it's not the Chamber Bureau that's changed. It's the Alamo. For the past decade or so, the Alamo Bar has had the reputation of catering to rugby players, motorcycle toughs, local journalists and other undesireables. But the times they are a -changing. About six weeks ago the well-known watering hole was purchased by four Park City business-people: Bob DiTullio, Mary Wagner, Mark Stemler and Cindy David. Since then, well, you might not recognize the old place. Gone from the facade is the coat of grey metallic paint which made the bar look like an outgrowth of the Memorial Building. And underneath un-derneath the paint were some surprises: a gleaming sheath of copper on the front door, and a blue "U" outlined in white ceramic tiles, a vestige of the days the building served as the office of-fice of Utah Power and Light. Built in 1903, the structure also housed a bank before being converted to a bar about 20 years ago. According to DiTullio, the new owners aren't trying to make the place so exclusive so that it abandons its old clientele. But if you belong to a motorcycle club and you want to come in, you'll have to leave your jacket outside. "We're going to have a dress code," he said. "We're not going to have card games or gambling, and we're not going to have people busting the place up." In the old Alamo, another hole in the bathroom wall might hardly be noticed. The legendary Alamo bathrooms have been completely remodeled. The main floor of the bar has been resurfaced with ceramic tiles, about 10,000 of them, DiTullio says. A textured tex-tured surface and a new (bright!) coat of paint has been added to the walls. The vaulted cailing has been cleaned and sealed. The bar has been refinished. DiTullio confessed that he and his partners are way over budget on the renovations. "We were just basically going to clean it up and get it opened," he said. One of the new owners, Mark Stemler, is also one of the proprietors of The Club, immediately to the north. DiTullio acknowledges that there was some discussion about connecting the two establishments, and making the Alamo private. But that would have left only two public bars on Main Street. "We think there is a need for a place for the public to walk in," he said. "And we want the people that come in at noon time for a beer and a sandwich. Exceptions Excep-tions to Business Revenue License Tax. No business revenue license tax shall be Imposed under this Ordinance Or-dinance upon the following persons or businesses: Section 19.01 Any person per-son engaged in business for solely religious, charitable, eleemosynary or other types of strictly non-profit purposes who is tax exempt In such activities ac-tivities under the laws of the United States and the State of Utah, nor shall any revenue license tax be imposed on any person engaged in a business specifically exempted from municipal taxation and fees by the laws of the United States or the State of Utah; nor shall any revenue license tax be imposed im-posed on any nonprofit corporation duly incorporated incor-porated according to the provisions of the Utah Nonprofit Corporation and Co-operative Association Act; nor shall any revenue license tax be imposed upon any person not maintaining main-taining a place of business within Park City who has paid a like or similar revenue license tax or fee to some other taxing unit within the State of Utah, and which taxing unit exempts from its license tax or fee, by reciprocal agreement or otherwise, businesses domiciled in Park City and doing business in such taxing unit. Section 19.02 Any insurance in-surance company or agent. Section 19.03 Any sales or merchandise damaged by smoke or fire or of bankrupt concerns, where such stocks have been acquired from merchants of Park City theretofore regularly licensed and engaged in business; provided, however, no such stocks or merchandise merchan-dise shall be augmented by other goods; Section 19.04 A person, firm or corporation exhibiting goods for sale concurrent with and as an adjunct to a group display, meeting or convention duly authorized to be held in a publicly owned building; Section 19.05 A person who sells his own property which was not acquired for resale, barter or exchange ex-change and who does not conduct such sales or act as a participant by furnishing fur-nishing goods in such a sale more than twice during any calendar year. Each person seeking this exemption shall furnish to the department of licensing licen-sing an accurate list with the names, addresses, telephone numbers of all persons contributing items to said sale. Said list shall be filed with the Licensing Department at least ten days prior to the sale; Section 19.06 Arts Exhibit, where participating par-ticipating artists sell their original works and which do not contain any sales of art works purchased elsewhere and held for resale, providing said art exhibits are sponsored by a local, responsible organization. SECTION 20. License Fees Declared to be a Debt. Any license or tax due and unpaid unaer this Ordinance and all penalties thereon shall constitute a debt to Park City and shall be collected by court proceedings in the same manner as any other debt which remedy shall be in addition to all other existing remedies. SECTION 21. Fee and Tax Payments, Prorations and Penalty. Section 21.1 The annual business revenue license tax provided in this Ordinance Or-dinance shall be due and payable to the City on the first day of January each year. New annual licenses shall be issued for the unexpired portion of the calendar year in which issued unless otherwise specifically privided; and the revenue License tax to be paid therefor shall be paid at the time of application ap-plication and shall be prorated on the basis of one-twelfth of the total annual tax for each month remaining in such unexpired unex-pired portion of the calendar calen-dar year, including the month in which such new license is issued. Section 21.2 If a business which was licensed licen-sed in the imemdiately preceding calendar year pays the business revenue license tax within fifteen (15) days of the date of the billing for the renewal of the license, the revenue license tax will be reduced Section 21.3 Businesses may elect to pay the revenue license tax in three (3) equal monthly in three (3) equal monthly installments due the first day of January, February and March. Section 21.4 In the event any revenue license tax is not paid on or before the fifteenth day of January of each year, or if elected to be paid in three (3) equal monthly installments, if such installment is not paid on or before the first day of January, February and March, a penalty of 25 percent of the unpaid amount plus interest on the unpaid amount at the rate of 18 percent per annum an-num shall be assessed, which penalty shall become part of the tax imposed im-posed by this Ordinance. Section 21.5 If the revenue license tax and any penalty are not paid by March 31 of each year such business shall be subject to immediate in-closure in-closure and shall remain closed until the delinquent revenue license licen-se tax and any penalty are paid in full. Section 21.6 If a licensed licen-sed business enlarges its place of business or increases in-creases its capacity for conducting business (i.e., adding square footage, increasing in-creasing number of vending ven-ding machines, or increasingly in-creasingly hourly user capacity), an additional revenue license tax shall be due and payable to the City and shall be proprated on the basis on one-twelfth of the total annual tax on the enlargement or increase for each month remaining in the unexpired portion of the calendar year, including in-cluding the month in which such increase is accomplished. ac-complished. Renewal of License Certificate. Upon receipt of the revenue license tax, the division shall Issue license certificate valid through December 31 of that year. SECTION 24. Records to be Maintained. It shall be the duty of every person liable for the payment of any revenue license tax Imposed by this Ordinance Ordinan-ce to keep and preserve for a period of three (3) years such books and records as will accurately reflect the factors used in determining the amount of the revenue license tax for which he may be liable under this Ordinance. SECTION 25. Revenue Tax Adjustment to Avoid Burdening Interstate Commerce. The business revenue license tax Imposed Im-posed by this Ordinance shall not be applied so as to place an undue burder on interstate commerce. In any case, where the revenue license tax is believed by a licensee or an applicant for a license to place an undue burden upon interstate commerce, commer-ce, such licensee or applicant ap-plicant may apply to the Director for an adjustment of the fee so as to relieve such burden. The licensee or applicant shall, by supporting sup-porting affidavits, indicate his method of doing business and such other information as the Director Direc-tor may deem necessary in order to determine the extent, ex-tent, if any, of such undue burden. The Director shall then conduct an investigation, in-vestigation, comparing the subject business with other business of like nature and shall make findings find-ings of fact from which he shall determine whether the revenue license tax is discriminatory, unreasonable unreason-able or unfair as to the licensee or applicant from the standpoint of Its impact im-pact on interstate commerce com-merce and shall recommend recom-mend to the City Council an appropriate revenue license tax under the circumstances and the City Council shall fix the revenue license tax in such amount. If the regular revenue license tax has already been paid, the City Council shall order or-der a refund of any amount over and above the amount of the revenue license tax fixed, if any. In fixing the tax to be charged, the Director may use any method which will assure that the tax assessed shall be uniform with that assessed on business of like nature; provided, however, that the amount assessed shall in no event exceed the regular tax prescribed in this Ordinance. Or-dinance. SECTION 26. Criminal Penalty. Any person that willfully violates any provision of this Ordinance Ordinan-ce shall be guilty of a class B misdemeanor. SECTION 27. Repealer Clause. Park City Ordinance Or-dinance Numbers 10 74, 10A - 75 and 10B - 75 are hereby repealed by this Ordinance. SECTION 28. Separability Clause. If any subsection, sentence, clause, phrase or portion of this chapter, including but not limited to any exemption, is for any reason held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect af-fect the validity of the remaining portions of this chapter.
