Show Singers, Weller settle water dispute The Singers won a small trict Court Judee Rrvant H. Shp ha victory Monday in their fight against eviction from a 2.5-acre farm in Marion, just north of Kamas in Summit County. Attorneys representing the family of slain fundamentalist fundamen-talist John Singer and the owners of surrounding property pro-perty worked out a settlement settle-ment to allow the Singers continued use of irrigation water which had been cut off last week. "I'm going to get the water that I need, and that, right now, is a victory," Vicki Singer, John Singer's widow, said following the settlement. settle-ment. No other details were disclosed. The Singers' use of irrigation irriga-tion water became a point of controversy July 1 when a neighbor, Jared Weller, forcefully prevented two members of the family from diverting water onto their property. Weller also is involved in the legal battle to evict the Singers from the farm they occupy in Marion Park Estates. Following the July 1 incident, inci-dent, Vicki Singer obtained a temporary restraining order enjoining Weller from assaulting as-saulting her children and interfering with the use of the water. Mrs. Singer claimed that Weller had used violence to prevent her 14-year-old son Timothy and son-in-law Adam Swapp from using the water. Service currently has been restored, said sources at Community TV of Utah, except ex-cept for a local-origination channel. Sgt, Joe Offret of the Park City Police Department said the thieves climbed the fence surrounding the storage building on Highway 248 near Prospector Square and gained entry by cutting back a window screen. Detective Lloyd Evans said Community TV is now installing a night security officer of-ficer around the area, and plans to completely burglar-proof burglar-proof their facilities with alarms. The Park City theft is not an isolated case, according to police. Thieves stole equipment from a Sandy cable company, and local police are comparing notes with Utah County detectives, in whose jurisdiction the theft occurred. The most expensive item stolen, noted Offret, was a Holiday fireworks start grass fire A small grass fire ignited by fireworks on the Fourth of July has generated a warning warn-ing from Fire Marshall Herb Johnson about volatile conditions condi-tions in the Park City area. Johnson said that the Park City Fire Department was called to 158 Main St. about 10:30 p.m. to extinguish a grass fire. "Trying to get those fire engines up and down those hills was a horrible task," he said. my trict Court Judge Bryant H. Croft about 4 p.m. July 1. However, before the order was served, the Singers discovered that a portion of the irrigation ditch had been filled in with dirt. On Monday, attorney Kathryn Collard appeared before Judge Croft to ask for a preliminary injunction to guarantee the Singers continued con-tinued use of the water and prevent further assaults on the family. "On July 1 1 was informed by Mrs. Singer that one of her children and a relative were attempting to irrigate their property by taking water from an irrigation ditch when they were assaulted as-saulted by Jared Weller," she told the court. "I was extremely concerned con-cerned that nothing else of a violent nature take place on that farm." Collard acknowledged that the question of the ownership of the land and the water rights could not be resolved "without some discovery," but suggested to Croft that the status quo be maintained until that legal process could take place. "But they couldn't, even with the court's permission and order, dig out their little channel," she added. "It's under about 25 feet of dirt right now." Attorney Ronald E. Kunz, representing Weller, charged that Mrs. Singer had no legal claim to the irrigation water. "She has never had a turn. $5,000 "BIE marce." Channel 8 still is inoperative at this writing. Viewers reported the loss of service at 3:30 a.m. Saturday, according to Kim Harding, cable outlet manager. But the 600 cable subscribers still were able to receive the three network stations in Salt Lake, plus UHF Channel KSTU over the weekend, he added. Offret said the other items stolen included two amplifiers amp-lifiers off the satellite dish valued at $3,000 each; ("They were the easiest to steal because they were outside," out-side," said Tithan.) ; a Simpson Simp-son VOM valued at $150 (an ohm meter used to test electrical elec-trical energy); a $500 4-way power divider; and two receivers for satellite signals valued at $3,000 each. Tithan said the company brought replacement receivers from Provo and is renting two satellite dishes. Although the blaze was quickly extinguished, concern con-cern about the fire hazard remains. "It's awfully dry underneath," under-neath," Johnson warned. "And, as the summer continues, con-tinues, this top grass is going to get dry too." In comparison to other areas, the local fire department depart-ment spent a quiet Fourth of July. A rash of fireworks-related fireworks-related fires was reported around the state. According to Kunz, his client knows of only two or three occasions in the past 19 years, before last week, that the Singers had taken water from the irrigation ditch. But Collard said the Singers claim to have used the water regularly for the past 14 years. Judge Croft took that opportunity to warn the participants about committing commit-ting perjury. "Somebody is not truthfully stating the facts," he charged. Kunz said he was prepared to call several witnesses to support Weller's testimony, but Croft suggested that the hearing be continued the Mall) M mam THE PAT METHENY GROUP Saturday July 11th 7:00 p.m. $9.00 Advance $10 Gate JOHN PRINE HOYT AXTON JUICE NEWTON Hot Rize Sunday July 12th 1:00 i l y v 11 J THE BEACH BOYS Sunday July 19th 3:00 p.m. B.B. In an effort to find a compromise, Kunz and Collard Col-lard held a joint session with their clients in the jury room of the Summit County Courthouse. Court-house. They emerged about an hour later to announce that a settlement had been reached. However, the Singers still are confronted with possible eviction from the Marion farm. Weller has charged that the family does not hold title to the property, while Mrs. Singer claims the land was given to her husband by Jared Weller's father, the late Gustav Weller. A trial on the eviction proceedings has been set for Nov. 30. p.m. at Parkwest. 4& gs 2 ii r rwmi rr i , EAR -SU HlCSi88?
