There have been gossipy rumors of friction among some of the as sociate justices who were named by President Roosevelt after the bitter 1937 contest in which congress con-gress repudiated his plan to re-oranize re-oranize the court. Facts were few, however, and the extent of the conflict of view point still is undisclosed. But in two of the -.14 opinions delivered on Monday it became evident that some of the justices concluded it was appropriate publicly to call Frankfurter to account lor wnat they regard as "dangerous" or unwaranted opinions. The fact that Associate Justices Frank Murphy and Hugo Black have now expressed a degree of misconfidence in Frankfurter's approach ap-proach to legal decisions already has led to speculation regarding the successor as chief justice to Harlan Fiske Stone. If Stone chose to retire, as he could any time. Frankfurter would be one Mr. Roosevelt might consider con-sider to succeed him as head of the court .But if the issues raised by Black and Murphy continue to figure in court decisions, any president probably would pass over Frankfurter on the theory that a Chief justice should have the confidence of the entire court.
