Another of Pratt's complaints is that the canal was not widened either above or below his property so he sees no reason rea-son for the massive amount of work done on the waterway through his land. Brough said that section of the canal flows slowly, allowing silt to build up to unacceptable levels, increasing the danger dan-ger of flooding. Additional disagreement between Pratt and the board of directors concerns con-cerns leaks in the canal as well as overflows. over-flows. Pratt said that since his wife purchased pur-chased the property in 1964, the only overflows have been caused by beaver dams, which Pratt has removed himself. him-self. He also said the only leaks have been caused by rodent tunnels that have been sealed by Rock Point Canal and Irrigation. Brough said leaks and overflows have been frequent due to the buildup of silt in the canal. Pratt wants the massive amount of soil and debris removed so he can use the land this season for grazing his horses hors-es and for recreational use by his family. fam-ily. Brough said it is necessary to let the soil settle at least until fall and possibly untiT next spring. At that time the situation situa-tion will be re-evaluated for the possibility possibil-ity of building an access road across the easement to make future repairs to the canal less difficult. Pratt said the work on the canal destroyed two deer trails that had been used frequently, allowing him to view wildlife crossing or grazing on his property. prop-erty. Deer can no longer cross the canal in that area because it has been widened wid-ened by several feet. Pratt also said the homes for a covey of quail, several rabbits rab-bits and two red foxes were destroyed by the work. To the Pratt family, this decreases the aesthetic value of the land if nil MmMMm MmmmmmmmM A mound of dirt, debris, sand and deadfall, created when Rock Point Canal was trenched and widened, stands higher than Jim Pratt, owner of the land where the easement to the canal lays. This wall stretches over dozens of yards of Pratt property. as well as their personal enjoyment. Brough said the irrigation organization organiza-tion has no legal obligation to remove the debris or the deadfall as long as it lays within the boundaries of the easement. ease-ment. He said the plans to do some cleanup after the mounds have settled have been made out of courtesy and consideration con-sideration for the Pratt family. Utah Water Rights Law, Title 73, Chapters 1 through 6 from the Department of Natural Resources states, "The owner of any ditch, canal, flume or other watercourse shall maintain the same in repair so as to prevent waste of water or damage to the property of others..." oth-ers..." The mandate for Rock Point Canal and Irrigation is clear. They must do whatever they can to prevent the canal from flooding and there can be no doubt that was difficult during this wet year. At the same time, the damage done to the Pratt property for dozens of yards along the easement for the canal is significant. sig-nificant. The problem for the Pratt family is that they think the work was overdone and the damage was far more than necessary nec-essary for flood prevention. On the other hand, if the work hadn't been done and homes had been flooded, Brough and the other members of the board (Lyle Taylor and Dan McKee) would have received many more complaints and would possibly pos-sibly have violated the state law. Land owners join in State efforts to reduce damage from the notorious pine beetle The Mountain pine beetle is the most destructive pest of pine forests in the western United States. This bark beetle attacks and kills several species of pine tree common to Utah and is currently a threat to pine forests throughout the state. The Utah Division of Forestry, Fire and State Lands has enlisted the aid of more than 145 private landowners landown-ers in a cost share effort on the north slope of the Uinta Mountains, south of Evanston, Wye-., to take action to protect pro-tect their forested lands. Landowners in the following communities are participating; par-ticipating; Manorlands, Uintalands, . Wilderness Acres 20 and the Bear River Lodge. Using a registered insecticide for use against the pine beetle, a spraying spray-ing program will be conducted the week of June 23 through 27 in an attempt to minimize damage from this devastating pest. "The beetle finds a suitable host tree and chews through the outer bark into the underlying tissue," explained Forest Health Coordinator Colleen Keyes. "Once inside the beetle lays its eggs and that begins a cycle that eventually even-tually kills the tree." Once the beetle gains a foothold in a forest it begins a relentless march unless action is taken to stop it," said Keyes. "Preventive sprays have to be applied before the end of June to have an effect." A secondary benefit of the spraying spray-ing program is to reduce the threat of wildland fire in an area already deemed "at risk." The addition of a large number num-ber of dead or dying pine trees will add immeasurably to the risk of a catastrophic cata-strophic fire. The cost share project is being conducted con-ducted using about $35,000 in USDA Forest Service Forest Health Protection Insect Suppression Funding. The Division of Forestry, Fire and State .
