NOTICE OF INTENTION PUBLIC NOTICE IS HEREBY GIVEN that on the 4th day of November, 1992, the City Council of Vernal City, Uintah County, Utah (the "City"), adopted a resolution resolu-tion declaring its intention to create a special improvement district to be known as Vernal City, Utah Special Improvement District No. 92-1 (Robinwood Lane Road, Curb, Gutter and Sidewalk Improvement Project) (the "District"). It is the intention of the City Council to make improvements within the District and to levy special assessments as provided in Title 17A, Chapter 3, Part 3, Utah code Annotated 1953, as amended, on the real estate lying within the District for the benefit of which such assessments are to be expended in the making of such improvements. DESCRIPTION OF DISTRICT Said proposed Special Improvement District 92-1 shall include the following properties: A. All properties abutting the north and south sides of 1100 South Street from 500 West through 990 West B. All properties abutting the east and west sides of 850 West Street from 1100 South through 11 89 South. C. All properties abutting the north and south sides of 1200 South Street from 850 West through 901 West D. Property abutting the west side of 650 West from 1100 South to, but not including, in-cluding, 1150 South. INTENDED IMPROVEMENTS The improvements to be constructed within Special Improvement District 92-1, in general, include road widening and paving, excavation for and installation of sidewalk, side-walk, curb and gutter and other miscellaneous work necessary to complete the work in a proper workmanlike manner. Said improvements shall be made along both sides of the street described above. ESTIMATED COST OF IMPROVEMENTS The total cost of improvements in the District as estimated by the City Engineer is as follows: A. Curb. Gutter & Sidewalk. The total estimated cost of the curb, gutter and sidewalk side-walk improvements to be paid by the property owners is $203,855.00. All costs shall be paid by a special assessment to be levied against the properties abutting upon up-on the streets where improvements are made. The property owners' cost for the improvements im-provements will be financed during the construction period by the use of interim warrants. The interest on said warrants will also be assessed against the property owners. The assessment shall be calculated by lineal front footage. Owners of comer lots shall be assessed for only frontage improvements to their property; side yard improvements im-provements for corner lots shall be paid for equally by all properties assessed. The total estimated costs of all road improvements including in-cluding the widening of the existing roadway to 38 feet, and the base improvement and repaving of the existing roadway, are $151,968. All costs associated with roadway road-way improvements as indicated above shall be paid by Vernal City. NOTE: The existing road right-of-way of 1100 South, 850 West and 1200 South is 66 feet wide. Proposed improvements to be made through the District will require only 52 feet of right-of-way. It is intended that the remaining 14 feet of right-of-way will be vacated and revert to the property owner of record fronting such vacated vacat-ed portion of right-of-way. LEVY OF ASSESSMENTS It is the intention of the City Council to levy assessments as provided by the laws of Utah on all parcels and lots of real property to be benefited by the proposed improvements im-provements within the District The purpose of the assessment and levy is to pay those costs of the improvements which have been made for the benefit of all parcels and lots of real property within the geographical boundaries of the District and which the City will not assume and pay. The method of assessment shall be by lineal lin-eal front foot. The assessments may be paid by property owners in not more than ten (10) annual annu-al installments with interest on the unpaid balance at a rate or rates fixed by the City council, or the whole or any part of the assessment may be paid without interest within fifteen (15) days after the ordinance levying the assessment becomes effective. effec-tive. The assessments shall be levied according to the benefits to be derived by each property within the District Other payment provisions and enforcement remedies shall be in accordance with Title 17A, Chapter 3, Part 3, Utah Code Annotated 1953, as amended. All information related to the proposed District is on file in the office of the City Recorder which will make such information available to all interested persons. TIME FOR FILING PROTESTS Any person who is the owner of record of property to be assessed in the District described in this Notice of Intention shall have the right to file in writing a protest against the creation of the District or to make any other objections relating thereto. Protests shall describe or otherwise identify the property owned of record by the person or persons making the protest and shall indicate the total lineal footage represented rep-resented by said protest Protests shall be filed with the City Recorder of Vernal City, Utah, on or before 5:00 pjn. on the 16th day of December, 1992. Thereafter at 7:15 p.m. on the 16th day of December, 1992, the City Council will meet in public meeting at the offices of the City Council to consider all protests so filed and hear all objections relating to the proposed District. After such consideration and determination, the City Council shall adopt a resolution resolu-tion cither abandoning the District or creating the District either as described in this Notice of Intention or with deletions and changes made as authorized by law; but the City Council shall abandon the District and not create the same if the necessary number of protests as provided herein have been filed on or before the time specified speci-fied in this Notice of Intention for the filing of protests after eliminating from such filed protests: (i) protests relating to property or relating to a type of improvement which has been deleted from the District and (ii) protests which have been withdrawn with-drawn in writing prior to the conclusion of the hearing. The necessary number of protests shall mean the aggregate of the protests representing one-half of the front footage of property to be assessed.
