(AP) An Idaho-based motorized recreation group wants the National Park Service to take another look at its ban of snowplanes on Jackson Lake in Grand Teton National Park. The Blue Ribbon Coalition, based in Pocatello, is hoping a federal judge issues a favorable ruling on snowmobiles, which the group believes will open the door for the return of snowplanes to the lake. U.S. District Judge Clarence Brimmer in Cheyenne is mulling whether to strike down a Ointonera ban on snowmobiling in Grand Teton and Yellowstone national parks. Jack Welch, a part-time resident of Jackson and president of the coalition, said if Brimmer scraps the 2001 rule, it might send the Park Service back to the drawing board and result in a possible review of the snowplane ban. More than 100 people held permits to operate snowplanes on Jackson Lake before the ban. Park Service officials say the snowplane ruling does not need to be revisited because it was not raised in the lawsuit that challenged the snowmobile ban. "We're not realistically saying that the parks should have unlimited access by snowmobiles and snowplanes,11 Welch said recently. "We're just saying that in the long-term rule that the Park Service will be working on, that we're back to square one on all of the issues." Attorneys for snowmobile manufacturers, winter resorts and the states of Wyoming and Montana have asked Brimmer to permanently lift the snowmobile ban so wintertourism businesses near the parks can have peace of mind about their survival and to prevent the 2001 ban from being reinstituled as was ordered last December by another judge. The ban, originally designed to take effect last winter, was set aside in early 2003 by the Park Service to settle a lawsuit filed by snowmobile makers. Under the agreement, new rules were drafted to allow a limited number of snowmobiles, in the parks rather than requiring visitors to use mass-transit snowcoaches. Brimmer set aside Sullivan's decision in February and the Park Service is again working on rules allowing limited snowmobile use. Earthjustice attorney Abigail Dillen, who represents conservation groups trying to reinstate the snowmobile ban, called the latest legal moves posturing. "They're betting on (Brimmer) to give them a resounding decision about how snowcoaches are a bad idea," she said. Denver's summer ozone levels down DENVER (AP) Cool, wet weather largely helped the metro area have one of its best summers for air quality in a quarter-century. During the summer, 15 ozone monitors in areas from Fort Collins to Colorado Springs failed to record a single day when concentrations of ground-level pollutant exceeded the federal limit of 84 parts per billion for eight consecutive hours. In the summer of 2003. ozone levels surpassed that limit on 17 days. Because of this year's readings, Denver is technically back in compliance with the eight-hour ozone standard, which is a rolling average of the fourth-highest ozone readings over tliree-straighl years. Pollution levels dropped so sharply that the stale's top health official wants the Environmental Protection Agency to consider declaring the region in compliance with a tough new federal ozone standard before the EPA's 2007 deadline. Regardless of the EPA's decision, the state doesn't plan to end any of its ozone-control programs, said Doug Benevento, director of the Colorado Department of Public Health and Environment. EPA and state health department officials say the turnaround is almost completely due to this summer's cool weather. Heat waves next summer could pull the area back into pollution-filled days. Ozone is formed when chemical vapors contained in engine exhaust, smokestack emissions, solvents and other sources react in the presence of heat and sunlight. Prevailing winds often concentrate the pollution against high ground to Denver's west and south. The EPA ordered Denver gas stations last spring to sell a special low-volatility gas to reduce vapors that lead to ozone formation. Refiners estimate the gas costs 6 cents per gallon more. Stan Dempsey of the Colorado Petroleum Association said the EPA should consider relaxing the volatility standard to help lower gas prices. But air-pollution lawyer Vicki Patton. of Environmental Defense, said that would be premature. "It's inappropriate to gamble with our children's health based on what everyone understands was an unusually wet and cool summer," she said.
