Show herein and within the time allowed al-lowed by the office of the State Engineer of the State of Utah; and praying that the within entitled en-titled Court make its order confirming con-firming the filing of his water user's claim at this time, and directing di-recting the State Engineer of the State of Utah to duly consider the same and make proper awards thereunder the same as if said water user's claim had been duly presented and filed within the time required by said summons and notice and within the time allowed by the office of the State Engineer of the State of Utah; and which petition now on file in the office of the Clerk of the within entitled Court, at Parowan, Iron County, Utah, is hereby referred to for further-details further-details and particulars; and good cause appearing to the satisfaction satisfac-tion of the Court therefor: IT IS HEREBY ORDERED that the water users having water wat-er rights within the Escalante Valley Drainage Area, including the Beryl and Milford Underground Under-ground Areas, andor any other persons having an interest in the subject matter of the within entitled en-titled general adjudication proceedings, pro-ceedings, show cause, if any they have, in the Court Room of the County Court House, at Parowan, Paro-wan, in Iron County, Utah, on the 10th day of December, 1952, at the hour of ten o'clock A. M. of said day, or as soon thereafter as counsel can be heard, why the Court should not proceed with a hearing on said petition and thereafter make the order prayed for in said petition and as more particularly hereinbefore set forth. It is further ordered that np-jtice np-jtice of this Order to Show Cause and said petition and the hearing hear-ing thereon shall be given by publication of a copy of this order in the Milford News, a newspaper having general circulation cir-culation in Beaver County, Utah, and the Iron County Record, a newspaper having general circulation cir-culation in Iron County, Utah, for three consecutive issues next preceding the time fixed herein for showing cause; and it is further fur-ther ordered that such notice be given by service of a copy of said petition and this order to show cause on the State Engineer Engi-neer of the State of Utah at least 20 days before the time fixed herein for showing cause. ' Upon reading and filing the Petition of Earl E. Barton, of Loveland, Colorado, alleging . that he is the owner of the fol lowing water rights situated in the Escalante Valley Underground Under-ground Water area, to-wit: 900 gallons of water per m;n ute o be used for incidental stock-watering and domestic purposes pur-poses and for the irrigation of the West Half - of the Southeast Quarter of Section 36, Township 34 South, Range 17 West, Salt Lake Meridian, in Utah from e well 50 feet north and 2600 feet west of the Southeast corner of Section 36, Township 34 South, Range 17 West, Salt Lake Base and Meridian, and, which water right has been more particularly set forth in detail in underground water claim No. 17071, filed in the office of the State Engineer of the State of Utah on the 23rd day of November, 1945; and which petition further alleges al-leges that through excusable neglect ne-glect and inadvertence water user's claim for such water right was not filed by his predecessors in interest or himself within the time set forth in the summons and notice heretofore published |
