Show Fifth District Court sees varied week Fifth District Court action was varied this week, with Judge J. Harlan Burns on the bench. Milton Rogers and Merrill Tillahash pleaded guilty to charges: Tillahash to a Class A misdemeanor, and Rogers to a third degree felony of forceable sexual abuse. Tillahash was also originally charged with a third degree felony, but the charge was reduced. Judge Burns ordered a 30-day diagnostic report by the Department of Adult Probation and Parole before sentencing. Michael Blake Jensen appeared before Judge Burns for sentencing after recently returning from a 90-day evaluation at the Utah State Prison ordered by Burns. The court stayed the imposititon of the sentence and placed Jensen on two years probation. One term of such probation was that he spend 90 days in the Iron County Jail, subject to work or school release. He was also ordered to make $400 restitution. Mark Evan Milby also appeared for sentencing, having pleaded guilty to a third degree felony, theft of a firearm, earlier. The judge again stayed the imposition im-position of the sentence and placed Milby on two years probation. One term of the probation is that he spend 30 days in the jail, subject to work or school release. He was also ordered to pay restitution as well as $200 to Iron County to pay for defense costs. David Edward Harrison, who earlier pleaded guilty to third degree felony theft and burglary charges in connection con-nection with the break-in and theft at the Medicine Shoppe in Cedar City, appeared for sentencing. ' Judge Burns ordered him to undergo a 45-day evaluation with the Utah Board of Corrections. Howard Hay Johnson also appeared lor s sentencing after pleading earlier to a charge of burglary, a third degree felony, He was sentenced to zero to five years in the Utah State Penitentiary, with the execution of such stayed. He was placed on two years probation, with one term of such being that he spend 30 days in the Iron County Jail, subject to a work release program. He was also ordered to pay restitution in full and an additional $200 to Iron County for court costs. Craig Whitney pleaded guilty to a second degree felony, burglary of a dwelling. The judge ordered a 30-day evaluation before sentencing. Kevyn K. Atkinson pleaded not guilty to a charge of theft by deception, a third degree felony. A trial date will be set. Hannah Rebluud pleaded not guilty to three counts of forgery, a third degree felony. A trial date will be set. Dennis Lee Simmons and Michael Ray McFarlane were arraigned on a charge of aggravated assault, a third degree felony. They both pleaded not euilty. A trial date will be set. |
