A A. Hollenbeck in successfully fighting the State Land Board Boar d tax case through the district i an and d Supreme courts was vas received by County Treasurer Porter Merrell l in in the form of che checks ks for 61 in payment of taxes on some of the property in in the county county coun coun- ty taken over by r the Land Board Not only is the county enriched by this tax payment pay pay- ment but we ve can feel pretty sure that with this additional additional ad ad- amount invested by the State Land Board that body will make every effort to get the property back into private ownership p and on the tax rolls A At t the time the Supreme Courts Court's decision on the case was vas handed down do Mr Hollenbeck l expressed his opinion that the state would also be obliged t to o continue paying current taxes on this property as long as it held it butas but butas as this question was vas not at issue in the court case the Supreme Court avoided a decision on it To decide this issue would require first the assessing assessing as as- assessing of the property taken the over by state followed fol fol- fol- fol lowed loved by a test case in court if the state should refuse to pay the tax County Assessor Levi J. J Anderton I we ve understand would like to make this test by levying levy levy- ing an assessment on these lands but after advice from the state tax commission that that body did not believe the state could be made Blade to pay the county commissioners conc com missioners have decided against the assessment From a layman's viewpoint vie we ve would like to see this test made Mr Hollenbeck's I case on the matter of the delinquent tax seemed so watertight and the Supreme Courts Court's decision on that case so definite that it surely it sur elY seems that a s similar decision must follow fol fol- low v in the question of current taxes Duchesne needs every possible source of f revenue for at best only slightly more than half of the lands in the county are are taxable the rest being Indian lands and we ve feel the commissioners should be encouraged to back up if necessary with court action an attempt to collect taxes on these lands Regardless of this the taxpayers are grateful for the relief obtained through the payment of the delinquent de de- de- de taxes It provides much needed revenue both for the county government and for the administration admin admin- of our schools |
