buck tooele thoele utah november 5 1947 board of big game control salt lake city utah gentlemen we a group of tooele thoele sportsmen are sending you the spike of deer killed in the recent hunt there has been considerable discussion concerning the legality of the i spike s length and we would great ly appreciate your deci decision ion on this matter hoping to hear from you at your earliest convenience we are arg very cordially yours D W pfoutz chairman field stream by VERNON W SHIELDS the deer season might be over but tooele thoele county sportsmen are still griping about some of the ar rests that were made by certain game wardens warden g bes besides I 1 des the un called for arrest of two fellows who killed the elk all the f fellows e are epry much up in arms about the fining of mr wayne fawson for 1 his killing of a spike buck on one e of the horns from this spike is shown here the law states that a buck must have horns at least five in ches long to be legally killed it doesn doean t say anything about where or how you should make the meas ure ments if you measure this spike from the hair near the base of the horn to the tip it is four and one half inches long if you measure from the skull and that is where the horn really starts to the tip it is exactly five and one quarter inches long if it you were going to measure a cats cat s tail tall you would start from where it be gins would rit you youa all right in measuring a deer horn you would start from the skull because that is where it begins the law says horn so there is three quarters of an inch of horn from the top of the hair to the skull if you meas ure it this way and I 1 believe it is the correct way then mr fawson s deer was not illegal and he should not have been fined I 1 happen to be one of those guys who likes to see our fish and game laws en forced fact is I 1 try to do my share in seeing they are enforced but I 1 don t like to see anyone rail road ed into court in cases like th this is why be so technical anyway how can you tell if a buck has five inch spikes or of a four and one half inch spike at one hundred yards you it tell it ten feet from where you stood mr fawson act ed in good faith he try to hide anything because he figured he had a legal buck another thing this buck bucks s horns were never sub to the judge for evidence take a look at the picture Is it illegal or isn t aa I 1 am of the op that wayne has a case a the fish and game depart ment if he should care to push it I 1 have this spike horn in my pos session and it was positively tak en from the buck that mr fawson killed seeing as ap how we are talking a bout technicalities in law enforce ment here is a little incident that might interest you last week during the elk season some of the residents of lincoln a woke to find a cow elk wandering about in their back yards it was even photographed by a certain individual the peculiar thing a bout it was this cow elk did not leave lincoln alive it was shot and killed by two fellows who did n t have an elk permit the proper authorities were notified but a bout three minutes before they got there a certain party had arrived and attached his elk permit these authorities claimed that inasmuch as the elk had been tagged there was nothing that could be done about it I 1 maintain that there was something that could have been done about it it if they are going to be technical in one case they should be technical in another case Could rit these fellows have been arrested for carrying fire arms on a game preserve and for killing elk without a permit I 1 haven t been able to get my goose as yet but I 1 have really been hunting diligently and me with the best est goose call in the world sure I 1 can call em all right but what I 1 ive ve called them I 1 am afraid the chronicle would rit print the other day my very good friend hunting pal and the mayor elect of midvale dropped in at my home to show me a nice fat goose he had knocked over down at lake point its disgusting what it is he doesn doean t even own a goose call I 1 he said he snuck up on em ern but of the lorl that it was anil city we need more hunters to old sick one last week a movie star and his brother along with an attorney from hollywood california were guests of the fish and game gape de apartment part ment they were taken duck hunting on ogden bay and lat later er were taken around and shown our huge herds of elk and deer they made the statement that they aou would id be back here next year to do some hunting fine pub help us kill our deer ana and eik elk we can thank the fish and game department part ment they are spending our money to encourage outsiders to come in and kill off our wild life the duck season closes on monday nov at 4 04 p in duck hunting has remained good through the season and most observers say that there have been more ducks this year than at any time before |
