| Show MURDERERS OF MOAB OFFICER MAY YET FACE FIRING ELLIOTT AND PFOUTZ WHO KILLED MARSHAL R D WESTWOOD MAY BE EXECUTED FOR participation IN RIOT AT UTAH STATE PRISON hobert robert 11 elliott and delbert delbe webster pfoutz who murdered marshal R D westwood of moab and who were sentenced to life imprisonment may yet face a firing squad for their crimes as a result of their participation in an uprising in the utah state prison last wednesday elliott and pfoutz with four other convicts staged a desperate riot in an attempt to make their escape the jail break failed but not until oab convict had been killed two others wounded and two prison guards had been beaten into unconsciousness lewis death bridge serving time for robbery was killed by a guard as he attempted to scale the prison walls and two other convicts were wounded with buckshot the two guards who were severely beaten have recovered from their injuries ellott and pfoutz who took a prominent part in the uprising were uninjured A utah statute provides that anyone serving a life term who is convicted of assaulting another convict or guard must be punished by death assault by a convict serving less than ilfe life Is a felony and Is punishable by not less than three nor more than 20 years in prison the sentence to start after completion of the term which they are now serving of the six convicts implicated in wednesdays riot only elliott and pfoutz are serving life terms and hence are the only ones who may face a firing squad as a result of the uprising R E davis warden of the state prison in a statement made the day following the mutiny declared that he would insist that Milot tand and pfoutz be tried for asnault ae sault which offense carries the death penalty both of the convicts were recognized by deputy warden W F v giles and guards B ia L christenn and D 1 L reese as members of the gang which assaulted them if they are convicted of the crime there Is no alternative under the wording of the law except the death penalty elliott and pfoutz warden davis declares have caused a great deal of trouble in the state prison ever since their incarceration both have been implicated in previous attempts to escape last year elliott was shot by a guard as he tried to scale the prison walls aw the two convicts shot marshal westwood of moab in the county jail at moab where they were being held to answer a charge of robbery they had smuggled a revolver into the jail and when marshal westwood estwood Wt took their supper to them they shot him without warning they escaped from the jail following the murder but were soon recaptured and several months later on the eve of their trial they made a second escape which likewise proved futile |
