Show HOOVER OIL POLICY UPHELD BY COURT president hoovers policy of complete conservation of government oil and the steps taken to enforce it were sustained today by the district of columbia court of appeals in a majority opinion the court upheld as valid exercise of executive power an order by secretary wllbur rejecting all applications for permission to prospect for toll on the public domain the presidents policy was enunciated in a brief informal statement to newspaper men a few days after his inauguration and order was issued immediately thereafter justice josiah van dissented from the courts majority opinion and held the policy could have been made effective only upon the issuance of a formal presidential proclamation the decision was based on an opinion of the supreme court which held in the midwest oil case that the dent could make temporary withdrawals of public land without formal proclamation the case in question was brought by roy G bardln who filed an application for a prospecting permit at las cruces N M two justices of the district of columbia supreme court frederick L siddon and jennings bailey have held wllbur exceeded his authority utah and other public land states of the west intervened in the actions before the courts of the district of columbia dealing with the order of secretary of the interior ray lyman wllbur refusing further prospecting permits the states won in the supreme court of the district but now lose before the court of appeals of the district i both governor george H dern and attorney general george P parker monday received messages telling them of the action of the court of appeals and the governor was urged at once to take steps looking toward cooperation of the western states in appealing the issue further to the supreme court of the united states peter Q washington D C of counsel for the states notified mr parker as to the decision of the court of appeals adding the explanation that the court upholds the right of the secretary to promulgate a new policy and saying that copies of the decision will be forwarded george D parkinson of salt lake telegraphing governor dem from las vagas nev quotes a similar telegram to him from mr which added the hope that arrangements could be made for the public land states to cooperate in appealing to the supreme court mr parkinson suggested that the governor telegraph to mr to the effect that utah would cooperate in such an appeal |
